The general rule is that for low-tier stuff no-one really cares. For effects like burning/sunbeams etc. it makes people quite unwilling to buy at full price

it's funny when people point out that their stuff is unduped even when it's a new hat/effect when that wouldn't even have been possible anyways.

How duping works is that when someone hijacks an account and trades the items away, valve will restore the items, creating a second version of the item that has the exact same history.
