For those people that prefer keeping to the class color scheme, its there as an option, but not required. Therefore at minimum you would need contractual permission(not just steam chat) from the original creator or to include them in the item revenue. Just like you cannot make a Spongebob t-shirt without legal permission from Nickelodeon, you cannot make a festive community weapon without permission from the original creator.

Is there a contract content creators have to agree too in order to have items they created be implemented in the game by chance? If content creators have to give up the rights to their work, it'd more then likely say that in any contract that they have to agree too in order to get them into the game I'd think.
The original creator has full rights over the accepted item. There is a pretty old page which I am sure legally still stands as it hasn't been removed. Plus I would hope they treat the artstyle as more important than avoiding trader tears.

Things that actually effect gameplay. It wouldn't benefit them to update items since I am sure it has little effect on sales.

I will admit though, I have seen one loadout with the hazmat on sniper I liked though, although it's only because the hat with it covers up the majority of the hazmat mostly though.
