I know when I said "These" it sounded like I was implying Shattered Horizon wasn't an indie game. But what I meant, is that Audiosurf and Eufloria are much better examples, because of their success.

I can't imagine any game coming from a developer who actually thinks this competition is a good idea would make anything desirable anyways. I know indie game developers aren't supposed to be legal analysts or anything but I'm pretty sure anything with Activision in the title raises a red flag for anyone who is even remotely knowledgeable of the gaming industry.
