It is legal. He said somewhere that VALVe no longer cares about the beta, other than the fact that the beta sourcecode/maps shall/will not be used in commercial products.

Anyone want to try to get coop working on the beta? Might be fun for a while.

The leak is useless to most people, and even bothering with it isn't worth it. There is nothing special about it besides exploring all the maps in the mappack, don't expect to be compiling and running the code without some knowledge and modification.

If you want to play the E3 maps and the like, missing information is your best bet.
