Digital Millennium Copyright Act of 1998 (US) legalises exactly what you said. Checking a box and saying I agree now does put you in a legally binding contract with the publisher and developer.
Also, agree to the terms of conditions on a website is legally binding too. Otherwise, why would they bother asking you to agree?

is gonna hold a lot more weight than...
