He was near A LOT of people and just decided to steal it. Of course the guards are going to know about it. And the guards are not omniscient if you kill all witnesses of a crime I believe.

Stealing horses isn't really viable anyway, they return to where you stole them from when you leave them.

This probably means it will be in a lava filled cave, because its Volcanic in Origin. I hope Ebony armor is glossy in Skyrim too.
