yep okay so my Just Cause 2 stutters like a motherfucker.

when I turn, or something explodes, it drops from 120fps to under 30, and constantly between the two extremes causing massive stutter.

I really know it shouldn't be doing this, it should run at a solid high framerate. any ideas?

Specs: 5970, i7 920. Game is maxed out.

Though I am unsure why you are getting it with those specs, you may have vsync enabled, this will lower your frames down to 30 if you ever go bellow the rate it is set, so turn that off.
You could also add "/frameratecap=30" to the launch options in steam if it doesn't fix it, this will stop the stutter, but also give you lower fps, obviously.

check your pre-rendered frames (flip queue size) you may need to raise it. (or lower)

you may experience mouse lag or input lag raising it above 3, and lower fps at 0

nope. i get a higher fps when it's normal, straight down to 30 again during fps drop/stutter

I have a 4800 series and can run on high everything with no slow down at all.

Have you checked how hot your computer is running? On one of my previous computers I had an 8800 yet one day had a problem that certain games ran really badly. Like suddenly on TF2, even with rock bottom graphics options, my fps would never reach 30. Ended up been a problem with my motherboard, it was overheating, that in turn damaged the fans which stopped cooling it as much and eventually destroyed the motherboard and graphics card.
