I think there is an issue of royalties as well. Plus, if we do get a returning third party character, it will probably be Sonic.
Snake and Sonic were essentially donated, weren't they? Kojima practically begged Nintendo to use Snake in Melee, and Sonic Team wanted the same with Sonic as a sign of the two companies' improving relationship. Yeah I know royalties still happen, but to me it seems like if anyone will be the one to say yes or no to their return, it'll be the original IP holders. If Kojima's still a humongous Smash Bros fanboy and Sega still thinks there's a point to prove, I think they'll say yes.
The only difference between Kojima and Sega is that Sega's good will relationship has lasted.

I'm going off of scattered knowledge, as well as the fact that Sakurai said some characters sadly had to be left out (due to issues I personally am not aware of) and if I could think of any characters that would be left out (using solely my uneducated sense), it would be Snake, Toon Link, Sonic, and Lucas in order of most likely to least likely. I mean, say it's easy to make a character, which it apparently is--going along with your idea of the developer's opinions regarding the character's themselves, their balance, and relevance, Snake may very well be lacking in some of those categories (primarily relevance). Anyway, [B]hopefully[/B] they'll decide to put Snake in the new game. That's definitely something I want.
Snake wasn't so much an olive branch as Kojima showing up and being all "OMG I am such a massive fan of Smash Bros, I would LOVE one of my characters in it. Please? Pretty please with sugar?" They didn't have enough time to add Snake to Melee, so they basically told him "Sorry, we can't this time around. We owe you on the next one though." And so he was one of the first characters confirmed for Brawl.

The thing about Snake is he's hardly a Nintendo character and he doesn't have any real history with Nintendo. Oh yes, I forgot the terrible NES games, the not too popular Gamecube remake and the actually decent GBC game that no-one remembers. The last game he actually got on a Nintendo system was a port of an older game. So that's about 5 games compared to the dozens he got on Playstation. Quite frankly as much as I love Metal Gear and Snake, he was one of the worst fitting third party characters you could have. When he was confirmed, it opened the doors to a world of stupid suggestions for characters that are barely Nintendo. And since MGS5 is coming up, which isn't even on a Nintendo console and is a huge tone shift from the older games, having Snake represent that game would be incredibly unfitting. I could see Snake returning but just as easily I could see him not returning.
Guys, I've been looking at your lists, and while some of the predictions and hopes are sound, you've all failed to realise that Nintendo should totally put Goku in the next Smash Bros.
btw on a previously related note, once Waluigi is released I'm gonna figure out how to hack characters into my buddy's Wii (which I still haven't learned/figured out how to do) and then go up to the dorm floor above and invite everyone to play Brawl. At which point I'll film their reactions when fucking Waluigi and Mewtwo and other characters are playable out of the blue.
I hope Sonic comes back with some reworks to him to make him more interesting to play.

I remember be so disappointed that no Brawl hacks beyond character models were usable for me. Recently I realised it was probably due to the fact that I was using the Pal version of Brawl.

I think it's also worth mentioning that of the five characters removed from melee to brawl (Pichu, Mewtwo, Dr. Mario, Roy, and Young Link), only Pichu and Dr. Mario lack more recent equivalents* (Lucario, Ike and Toon Link). Although that can be explained for gameplay reasons, as they were both clones and I don't think they were popular. I swear the main reason Pichu was added was to be a dud for all-random matches.

No matter what someone's viewpoint is, there's always "evidence" in Sakurai's past decisions, and ultimately it usually just comes down to what that particularly person wants out of the game, and how they see things as a result. See, I really want Little Mac in the game. I can say he's iconic, the star of one of the most well known of Nintendo's NES hits, and has a recent sequel to boot, but ultimately, it's really just because I like him and I like Punch-Out that I think he'll make it.
Little Mac would be an amazing addition to the next smash bros, and I can't help but feel he's been strongly hinted at with that boxing ring. He better have a pink jumpsuit costume.
