Assist trophy, at best. No spin-off characters should be included, imo. Waluigi seems to be the exception due to his popularity, and filling in the "fourth bro" thing going on.

What I find a bit funny is that Wario was originally conceived as an opposite to Mario.
But when you look into it, Wario's personality is more of an opposite to Luigi's than it is to Mario's.
Wario is selfish. Mario and Luigi are selfless.
Wario is brutish. Mario and Luigi are nimble and agile. This is reflected in their respective games in the form of gameplay.
Wario is rude. Mario and Luigi are rather polite.
Wario is brave. Mario is brave. Luigi is timid.
I think it's pretty funny how Luigi's main games have him collecting as much money as he can, which is exactly what Wario craves. It's just Luigi does it while ridding houses of ghosts and Wario does it by shaking down enemies for every cent they've got.

He rises to a challenge when he's presented one.
For instance, when the Black Sugar Pirates flooded his castle and stole all of his loot, he barged through Kitchen Island to get everything back regardless of what stood in his way.
Yeah, he's doing stuff primarily for personal gain or revenge, but that doesn't mean he cowers away from whatever is waiting for him.
I would not say that he doesn't care, he's clearly shown signs of being scared. Rudy the Clown visibly caused Wario to jump in fear. Despite this initial fear he beat the tar out of Rudy.

Wario isn't brave, so much as [I]really[/I] greedy, where his greed succeeds any cowardice he has.
It's bravery powered by greed. Wario don't give a fuck about what's in his way because they've got treasure behind them and they're blocking his view of it.

I really do hope they shift Wario's focus to Wario World rather than Wario Ware. Wario ware just felt like a really weird spin-off.

Unfortunately Wario Ware is BIG in Japan. It's why Wario's default costume is the biker outfit and his moveset is more focused on being weird rather than being the stout bastard he is.
His smash attack still depresses me because of its miserable reach, his shoulder tackle is supposed to be something feared
They should give Wario Land to Retro or another of their American 2nd parties. I just want a really good, 3D treasure hunting game, with Captain Syrup, the shoulder bash, picking things up and throwing them, immortality, and being transformed by particular attacks. No fixed camera either, made Wario World feel like a beat-em-up. No sense of exploration.

I think that the deciding factor for Wario's inclusion in Brawl is probably the fact that he's major enough of a character to have his own game series. Not only is he the star of Wario Ware, but also Wario World. Luigi's got his own game, Yoshi's got his own game, even Peach has had her own game... and Bowser is the villain in the majority of Mario's games. Waluigi however has never been more than Wario's sidekick in party games.
I guess what most characters consist of is Main protagonist/s, main Villain, Sidekick and fan favorite in some cases.
If Waluigi is in the new one I will be very happy, I play him in Mario Tennis, Party and Kart

I think just about every character in the whole series can be justified if you think about it hard enough, basically any idea of some characters being "more deserving" than others is out the window.
Mario series definitely deserves another rep. I know people say "4 reps is enough" or "Yoshi/Wario/DK series are all Mario reps" but I think we need at least one more to represent the main series at this point. It is [I]the[/I] main Nintendo franchise after all
Bowser Jr. has been in five main-series Mario games as the secondary antagonist and is easily the most important of the possible reps.
Toad has also been in many games but his abilities as a fighter are probably extremely limited. Also who the fuck wants to play as Toad?
Paper Mario would be a fantastic representation of the Mario RPG games and is unique enough to provide a fun and interesting moveset.
Waluigi's presence in virtually every spinoff could nab him a spot but as fun as it would be to play as him I have a feeling that party/sports/etc games are not something that require representation over the main games or even the RPG games

If there is another rep, it should be toad. But Yoshi is definitely a Mario rep. He's in his own series bracket but that's nothing but an artifact, his branch hasn't been relevant in a long time. DKC and WL/WW are totally separate to mainline Mario.
Toad would be awesome. Give him an SMB2 based moveset, and make him strong and fast, attack with mushroom blocks (maybe even using a Snifit as a projectile). He's the best character in SMB2, first thing i think of with that game.

Well, he's part of the Mario Universe, but he also has his own separate franchise. Like Yoshi and to an extent DK.

He can be weird and still have his Wario Land feel. Project M pulled it off nicely.
Keep most of his current moves, change a few of them to have larger hitboxes, give him non-choppy walk and run animations. Update his Dsmash, Fsmash, shoulder bash as SideB instead of the bike, give UpB more control, give him ground pound as Dair.
They'd pretty much be done. His current moveset suffers from having way too much downtime or way too little range; really, who wants to do Wario'd down smash so they can be immobilized for a full second if they whiff? It's not even that powerful of a move. Wario Bike's utility in recovery means it's rarely going to be used on the battlefield or the user risks losing a lot of recovery potential. His forward smash is super low range, you're better off just grabbing someone and throwing them.
One of the most recurring arguments for Waluigi not being included is "He's not a major character"
