Seeing as every TES game has started with the player in jail, we can safely assume that Skyrim will start in some kind of jail.
Backstory: Drunken murderous rampage across Cyrodiil that made it appear as if the Nine had shat upon the entire nation and would make a Dremora weep in envy. Arrested and sentenced to 2353 days in jail.

They I'd go all rampage during the execution and set the King who'd be watching on fire.
That would make me king and I'd rule all of Skyrim, conquer Cyrodill and then the rest of Tamriel, So I could go on crusades to the other continents.

I read that as "coughing on one of the guards". I suppose that's a capital offense in Skyrim.
