In Gamestop, yes. You get $100 if you trade in your 3DS XL / PS Vita or $75 for a regular 3DS.

I don't know how stupid this question might be but I've never had a DS. I'm interested now but I've heard there's a new model coming to EU in february. If I were to buy one imported from australia would this region lock thing be a trouble here? only asking cause it would still be cheaper than local price it seems and I'd like to have one in a couple of days.

I don't expect it to be difficult at all to re-instate your preorder when they come back up, what with several hundred more spots now becoming available.
