I don't think piracy should matter if the game is out of print.
Reminder that piracy isn't evil or morally/ethically wrong. It's a tool to be used in very specific circumstances to experience something you can't experience through any other means.

It was weird, when I first softmodded my Wii, I made a list of all the games I wanted to pirate, but I ended up not actually pirating anything, and actually ended up buying a lot of the games I wanted to pirate due to either convinience or them getting re-released in some way.

While I agree for the most part, I've definitely considered pirating some of their games before, mostly Gamecube ones. Like a year or so ago I wanted to get a new copy of Kirby's Air Ride since mine was scratched to hell, but the only copies I could find were going for over $100.
I think it's only really justifiable with abandonware. Stuff that has been out of print in any form for ten to fifteen years or more, and the creator is no longer interested in its upkeep.
A majority of third party NES/SNES titles, some first and third party N64 titles, and certain under-produced Gamecube titles fit this description. The Gamecube only recently slipped into this category now that it is considered a legacy console (and is no longer officially supported)

Prices for physical copies of these old games are fucking crazy these days too. I remember getting Melee used from Amazon for 20 bucks back in 2010, but today it's up to like, 60. And don't even get me started on SNES games.

You pirated Banjo? I see that game everywhere. I even got a boxed copy. And isn't it on Xbox? I think you guys are looking at Amazon and eBay prices, go look at small pawn shops and you'll find everything you need
used my coins for dr luigi and nes remix since I was 30 short of starfox 3d (even though i had a unredeemed bayonetta code ;_;)
they're both fun little timewasters though.
Something no one has mentioned, but I personally emulate games I already own in official form.
Not all, but the small ones I like to play every once and awhile like Tetris and Wario Land 4.

The only game I emulated without buying it is Mother 3.
I bought the SNES version of Earthbound for $160. T_T I can understand if you dont want to pay for that. However, these days, it is available on the Wii U for 10

It honestly makes me wonder why so few developers re-release games digitally. There is clearly a market for it.
(Yes, I know that stuff like licensed titles and ones in legal limbo are probably never going to see the light of day again, but surely stuff like Oregon Trail, Backyard Baseball or pretty much anything by LEGO Media or LucasArts should have no trouble being re-released digitally. Heck, we have indie devs like Two Tribes re-releasing games on the virtual console for the 3DS yet major companies aren't raking in what is practically free money from the service.)
Arcade titles are the absolute worst about this. I can name over 100 arcade games that have never received digital releases or even console ports that I'd be happy to pay $5-to-$10 for now. Sega's and Konami's in particular.
I really hope that Bomberman 64 gets onto the Wii U Virtual Console.
I also hope the two sequels that I only found out about a few years ago and haven't had the chance to play get on. I like 3D Bomberman more than 2D Bomberman.

Super Nintendo games are frickin' whack on ebay. be prepared to drop $70+ for just the game card alone on several of them. Earthbound, Super Metroid, and the Final Fantasy games seem to be some of the biggest offenders. (And all three N64 mario parties, but that's another story)

It makes me glad that Natsume is one of the publishers that releases games on the virtual console frequently. Wild Guns (which has been available on the VC for a while) is worth almost $200 without any booklets or cartridges and a complete copy is worth nearly $1000.
I think the biggest reason conker/banjo/bomberman/insert90's game here will never return true to form is simply that... the people (or person) that defined what that game was either entirely stopped caring, passed away, or was fired. The old team that MADE X game, and when I say made, I mean it metaphorically has disbanded permanently
so now you see companies like microsoft, they know a banjo/conker sequal is wanted, they know it'll sell REALLY well, but they don't get that people want what the original team did, and people want a true to form game
they don't want a meat lovers pizza, they don't want a cheese pizza, they don't want garlic, they just want a pepperoni pizza
but they keep adding bullshit to said pizza and ruining the taste, sometimes to the point where there isn't even pepperoni at all

authentic 80's and 90's titles are a precious collectors item that has to be treated with respect
some people don't care and just want to play the game, so they download roms
but authentic copies are for playing the authentic experience + smiling at a shelf
