I don't think anyone should call anyone else a label based on clothes/actions, regardless of what they are.
Make independent judgements based on a person as a whole rather.

First of all, "hipster" started as more of a fashion trend than anything. It just so happens that these people also tend to irrationally dislike mainstream music, and pride themselves in bragging about their totally underground bands. Let me give you an example of an [b]ANNOYING HIPSTER:[/b]
[b]Person A:[/b] "Hey, do you like the Beatles?"
[b]Person B:[/b] "I did until everyone started listening to them... There's this other band called Butterflies of the Apocalypse that are [i]way better![/i]"
[b]Person A:[/b] "You're a fucking hipster."
[b]Person B:[/b] "Fuck you and your mainstream ideals, Person A."
This is a perfectly legitimate reason to think somebody is stupid. Calling somebody like this a "hipster" is totally appropriate and pretty funny.
Now let me give you an example of a [b]PERFECTLY NORMAL PERSON WITH LEGITIMATE OPINIONS:[/b]
[b]Person A:[/b] "Hey, do you like the Black Eyed Peas?"
[b]Person B:[/b] "I only like 1 or 2 of their songs. They're extremely overrated though, and it's annoying hearing them on the radio all the time. There's a lot of underappreciated bands that are much better."
[b]Person A:[/b] "You're a fucking hipster."
[b]Person B:[/b] "Okay."
This is an example of somebody unfairly calling somebody else a "hipster", and generally just being an annoying fuckwad.
[b]Aspect 2: Fashion[/b]
Skinny jeans, Ray Bans, ever so non-conformist Vans, t-shirts for some underground bands, a cardigan, a geeky hairstyle, and earrings. Classic hipster getup. If somebody is wearing all of this, or even most of it, it's probably safe to assume that they're into the hipster fashion. It's [b]not[/b] safe to assume that anyone wearing Ray Bans, Vans, or skinny jeans is a hipster, and it's annoying to be called one just because somebody's never heard of the band on my shirt. And I mean called one maliciously and degradingly; not in a friendly joking manner.
Especially skinny jeans. Jeans are just generally skinnier these days, as it is becoming the style of choice. Even in a business setting, slacks are being manufactured to be skinnier, and more slimming. It's just the trend of society, and a completely acceptable style. (I'm talking about moderately slim pants, not skin-tight ones.)
[b]Aspect 3: General Behavior[/b]
Somebody's probably a hipster when they exhibit any of the following behaviors:
[list][*]Instant dislike of anything popular
[*]Irrational dislike of something they used to like, simply because other people now know about it
[*]Dislike of other people simply because they are not "cool" enough to listen to the music the hipster likes
[*]Donning all or most of the aforementioned hipster getup (This is not always a sure indicator)[/list]
The following behaviors are [b]perfectly normal[/b] for any musically or artistically cultured person:
[list][*]Interest in new bands that have yet to be recognized
[*]Annoyance with the fact that a lot of popular music is [b]really shitty[/b]
[*]Annoyance with the fact that the aforementioned shitty music is more popular than music that is infinitely better
[*]Wearing the Italian style (Wayfarer) Ray Bans, which happen to be really nice sunglasses
[*]Wearing skinny (moderately slim) jeans, which like I said is really becoming the norm
[*]Wearing shirts for (or promoting in other ways) a band that you may not have heard of yet[/list]

Yesterday, I wore my skinny-esque jeans, Arcade Fire tour shirt, and Vans checkered slip-ons, and I'm not a hipster.
I listen to everything I find interesting (ranging from Lady Gaga to Panda Bear) and never diss anyone for (not) liking music or ever hearing of it.
All I spread is love.
I know plenty of hipsters, I find them fascinating/normal people.

The basic idea of hipster or nonconformity is self defeating when oversimplified and overused as op stated. You can look at any individual action someone takes and define it as conformist or nonconformist. It really isn't worth it, adjusting who you are based on how others will judge you, either as a hipster, or conformist. It may sound corny, but just being yourself is the only path to self identity and actualization.
Now, people call me a hipster all the time (I listen to pretty obscure music), and I jokingly agree but I don't identify with hipsters for one single reason: hipsters, in my mind, are dickheads. Pretentiousness, convolution, and judgment are things I associate with the hipster scene. Hipsters bash the tastes and opinions of others simply because they have a misplaced sense of superiority or clarity on every level. This superior bunch of people all seem to conform into themselves, forsaking anything they honestly feel or like as individuals for the sake of group or coherency in what is known as cool. A hipster is driven by the desire to belong to a group of self proclaimed 'individuals.'
This growing usage of "hipster" in our everyday vocabulary will dissolve the term into a meaningless shell.
Thinking being mainstream is the new not being mainstream is too mainstream now.
Late, but my friend has those ear-stretching piercings. Well, he did. He messed it up and put one in multiple sizes bigger than he should have, and he took it out while we were talking on the xbox, and all of a sudden he was going nuts shouted "Holy shit there's blood everywhere!". About an hour later he came back and was fine for about 5 minutes, then "Oh shit, it's bleeding again!" going hysterical. Funny times.
All the scene kids near me (basically hipsters) all have acoustic guitars, and pose with them for facebook profile photos. It's very annoying.
Being Hipster is too mainstream.

Hey, remember this guy, Adam Savage? Of course you do.
I like, like many kids, grew up absolutely loving Mythbusters. I also noticed, when watching this show, that Adam had some really cool looking glasses, so when it turned out that I was nearsighted, I decided was going to get glasses like his, pretty much one of my child heroes.
But now, I always get people calling me some non-conformist douche for it. Everyone needs to stop giving a fuck what's hipster and what isn't. I wear what glasses I damn well feel like wearing.
Actually, anyone wearing skinny jeans is usually an annoying faggot. Just saying.
At first I was like argh yeah those fucking hipsters but then I realized that I just hate everyone.
