Because he is already dead. He is an undead Judge to serve his purpose of ending all crime, which in his views only the living can commit. In 2000AD he was never killed off. He and the other 3 have only been locked up really. He has even been dragged to hell, but he's coming back. There is no way to kill him as destroying his body means his soul is still free to possess whoever he wants.

The Presence would be able to wipe out all DC characters at least, because every single character is in a fight.

No idea actually but we do know that The Presence exists in different universes. Back in the Kirby days people speculated that the TOAA and The Presence were the single entity but with different names. Doesn't matter because an omnipotent being is an omnipotent being. If there's another one then it would be a stalemate.
