• Help, my mom is being sued

if your mother didn't do anything to the ice infront of your house, then you should be fine, but if she did clear it or tampered with it in any way, she is liable from what i understand if you clear it and it ices over again, it's your fault for some reason but if you just leave it be, it's an 'act of god'. although I found this for some state... Won't help much but there's probably something somewhere regarding canada.
“any person, who removes snow or ice from the public sidewalk or street, shall not, as a result of his acts or omissions in such removal, be liable for civil damages.” In other words, the Chicago ordinance suggests that a business or property owner may be considered negligent for failing to shovel, salt or remove ice from the sidewalk, but not for removing snow/ice in a careless manner.
Just look into the laws or ask advice.
It can't uphold, he slipped on ice on a sidewalk (of which you do not own), which means he can't sue you for it. You're not required to clear the ice on "your" part of the sidewalk.. And if he's so sure that it's your property tell them he was trespassing. If he were smarter he would know not to walk on ice, the outcome generally isn't well.
The guy has no case against you. Don't worry about it.
Is there any proof that he fell on your sidewalk? Just get a lawyer, even a cheap one just out of law school should be able to handle this case.
I don't know about Canada's justice system but here in the US a couple trespassed onto city property, ignored all the warning signs and common sense, and had sex on the traintracks in a dark new york subway. They won the lawsuit
Yes, because all of facepunch has a law degree. Also, saying that about arabs isn't helping your case.
:objection: Sorry, felt it was fitting. ANYWAY, I don't think they would have a case unless your mom purposely made the sidewalk wet for him to slip and fall that day.
The retarded part is, if somebody breaks into your house, steals your shit, and cuts themself on something while doing it, they can still sue you.
Or if you only injure them if you're defending yourself. That's why you got for headshots :smug:
1. Sidewalk in front of your house, or sidewalk in your yard? If the former, you'll be fine. If the latter, keep reading. 2. Was he trespassing? 3. Was he engaging in any kind of unsafe behaviour that you can prove? 4. Was the sidewalk noticeably icy, or was the ice concealed with snow? 5. Most homeowners insurance plans offer liability protection of $1m or more. Contact your insurance company immediately. An expensive lawyer may not be necessary - your insurance company may simply settle.
They're not going to get anywhere close to $1,000,000 in Canada. The judge will probably laugh.
They're not going to get anywhere close to $1,000,000 in Canada. The judge will probably laugh.
You sue high to get a big settlement. Kind of like how a kid asks for a trip to Disneyland and eventually haggles down to a bowl of ice cream despite only wanting ice cream from the beginning.
Canada is not the land where you can sue anyone with any stupid reasons. Someone slip on your driveway or something? Handle it with your lawyers, change are near up to 100% you'll win and that the one who sued you will be laughed at by the judge. Beside that you've got insurance? You're fine then.
Counter sue him for being a selfish prick.
People are dumb as shit, when it comes to things like this. "Oh I broke my wrist and now I'm going to sue someone for a million dollars" Boo Fucking Who, cry me a river. This guy is an idiot, along with the other countless cases, where people are lazy and would rather steal the money by suing, then work hard for it themselves.
where people are lazy and would rather steal the money by suing, then work hard for it themselves.
Maybe he couldn't work because of the broken wrist and lost income [editline]10:13PM[/editline] Lawsuits have legitimate purposes.
Thats cold
Lankist, where are you when we need you :(
Fucking wow. America is not going to get any better if everyone is going to bitch about their rights and privileges instead of their responsibilities. I am really sorry, that's really fucking stupid. 1 Million dollars ? That's irrational beyond belief. Like a child whining.

Regardless, this guy is just an asshole. Countersue his bunghole until it can no longer be countersued, and instead of a butthole he just has a massive crater in which he grows mushrooms on
Ontario is a city in Canada.
:canada:
Maybe he couldn't work because of the broken wrist and lost income [editline]10:13PM[/editline] Lawsuits have legitimate purposes.
Yeah because I'm, sure this guy makes a million dollars a year. Depending on the job, if he is working a job that requires physical labor, then this guy is making less than 50,000 a year, for sure. I can understand though if he works this line of work. It takes 6-8 weeks for a wrist to heal. So it's pretty obvious this guy is a greedy bastard though. Plus medical bills wouldn't cost that much for a broken wrist.
And what do I counter sue for? Wasting our time?
Make a counterclaim on the basis of sever emotional damage due to the large amount of damages being claimed. It has affected your value of life. Also, if they are attempting to claim $1 million for breaking their wrist, it's likely they will only get nominal damages - no judge / jury will fork out $1 million dollars if what you said happened are the actual events. And, uh, you need a solicitor.
Go over to his house and shove a boot up his ass in his sleep. In court make claims of him stealing your boot.
Fall on his sidewalk and then sue him, better yet get facepunch to hurt themselves on this man's sidewalk. FACPUNCH BIKE TRICK CONTEST
:whoptc: Counter-sue him for chipping (or damaging) your sidewalk. (Seek equal amount as other party, etc.)
counter sue, you'll win its Canada.
If I broke my wrist on your side walk I would go to the doctor and get a cast. No need to sue over ice.
This guy needs to man the fuck up, it isn't your mums fault he slipped over. When someone pushed me over and I broke my wrist, I didn't fucking sue them.
Sue him for suing you with a unjust reason.
Your property does not include the sidewalk. Counter-sue him for unnecessary stress or something related.
Your property does not include the sidewalk. Counter-sue him for unnecessary stress or something related.
In Canada we call the concrete path through our yard that joins the door to the street a sidewalk as well.
