The case will fail. When it does, countersue.
You won't get a million dollars, but you might get something.
Also do you actually own the sidewalk?
Yeah I hope the judges in Canada are good. There's nothing really that I missed. Our sidewalk was icy on that day and he slipped and broke his wrist 2 years ago. A month later we had to contact our insurance company and about 2 days ago we just got this in a big envelope in the mail.
Well, ice isn't your fault, is it?
it's simple: say that by walking on your sidewalk during winter, he chose to accept the risk that it might be slippery and any consequence that follows
This was in Canada.
Ontario is a city in Canada.
Regardless, this guy is just an asshole. Countersue his bunghole until it can no longer be countersued, and instead of a butthole he just has a massive crater in which he grows mushrooms on
That's a big fucking city.
Slip on his sidewalk and sue them back
Correct my if I'm wrong, but at least where I live, all the sidewalks are owned by the city/state/government. What right does this guy have suing you for the governments faulty sidewalk?
If you own the sidewalk area, counter sue him for trespassing.
If it was raining/snowing he should be prepared.
If he didn't want to break his wrists he shoulda bought the pair of 200$ weather shoes, shoulda been more aware of the conditions, and should expect that in such conditions it is more likely for him to fall than a normal situation. Should have busted his ass rather than using his wrists to break a fall.
Just spit random shit at him.
Hurr Durr aside, you can't really control slipping/falling actions.
^Above posters suggestion too^
Wait, where do you live?
I know that here on the Canadian west coast the sidewalk belongs to the city and thus if someone busts their ass on the sidewalk in front of your house, they can't sue because it's not your property.
Someone is suing your mom because they slipped on your sidewalk...TWO YEARS AGO?
What the fuck?
This genuinely shows that times are getting tough. If people are getting desperate enough to sue over a two year old injury, our economic condition is obviously a shit ton bigger than that.
In reality, you aren't going to loose in a case like this unless your sidewalk was half caved in and caked in ice, even then he's not going to get anything for it. Counter sue the asshole for compensation for legal costs because that's downright shit. It's not like he had permanent damage from it, and if he did, I'm fairly sure he's out of any insurance for not filing a claim or doing shit about it as soon as it happened.
Hey so like my mom is being sued because someone slipped on our sidewalk 2 years ago. Basically 2 years ago a guy slipped on our sidewalk when it was icy and he broke his wrist from my understanding. Now he's suing us for 1 million dollars, 50k and his wife is suing another 50k.
My mom already talked to the insurance company and they said they would handle it. Yet the same guy (and his wife or vice versa) is opening another law suit against us. What can we do?
But yeah we just got a copy that says "To the defendants. A legal proceeding has been commenced against you." and it goes on to say that "If you wish to defend this proceeding, you or an Ontario lawyer acting for you must prepare a statement of defence in Form 18A perscribed by the rules of civl proceedure, serve it on plaintiff[s] lawyer[s] (<--what the hell is a plaintiff) blah blah blah, within twenty days." ((yes we are Canadian))
The dude is suing my mom for 1 million dollars in damages and 100 thousand dollars in special damages. And his wife is suing 100 thousand dollars because of 'Family Law act RSO 1990 c. F. 3" and special damages in 50 thousand dollars. Oh and I should also add that only the guy fell on our side walk and he broke his wrist apparently. Which is completely retarded for suing someone 1 million dollars for a broken wrist.
-After some searching it appears that 'Family Law act RSO 1990 c. F. 3' means this:
Source: http://www.e-laws.gov.on.ca/html/statutes/english/elaws_statutes_90f03_e.htm#BK3
I should also add that my mom makes about 20k (Canadian) a year and a single parent which makes this even more retarded.
If anyone has some information that helps; it would be much appreciated. Besides getting a good lawyer.
Wait for him to drive down the street and run infront of his car, then countersue/blackmail him. Simple...
Fuck facepunch, go consult a lawyer.
Over 1 million dollars for a broken wrist?
You live in fucking Canada. There are no medical bills to pay.
[editline]05:58AM[/editline]
Don't you have the right to an attorney in Canada?
Besides, aren't sidewalks property of the county/city/etc? If someone slips on a sidewalk and tries to sue, they are out of luck.
The guy slipped infront of the property. By law(in the US anyway) you own the land (and the sidewalk on your property) and are responsible as a homeowner of keeping them clean.
I hope I'm not late.
In the UK, if it is icy or snows, leave your sidewalk or pavement outside your drive or house UNTOUCHED.
If there is ice or snow on it and you leave it untouched, you are not liable for slipping/breaking and cannot be sued. BUT if you shovel even a little bit of snow or try and put salt or something down, you are liable.
Remember this, can be useful.
If they say you "own" the sidewalk (and that it's your sole responsibility to keep it safe for a pedestrian), then it makes equal sense that whoever walks on it without permission is trespassing your property.
Just be sure to not listen to the people telling you to go shove your boot up his ass and stuff like that.
1 million dollars, 50k and his wife is suing another 50k.
:what:
To my understanding 50,000 + 50,000 = 100,000
Or do you mean that they are demanding an exrta 100,000 ontop of that one million bill?
Correct my if I'm wrong, but at least where I live, all the sidewalks are owned by the city/state/government. What right does this guy have suing you for the governments faulty sidewalk?
Words of pure wisdom.
Also, I thought it was just us Americans that blew lawsuits out of our asses at such great proportions. :raise:
Over 1 million dollars for a broken wrist?

if the wife is suing for the same amount as the guy is, I'm willing to bet SHE'S the serious hard-ass in this situation, and that the guy is just matching her because he can't wank anymore.
What does that asshole's wife sue your mom for?
In Australia you don't own the sidewalk or the nature strip out front, the government cut down a tree on our nature strip but there was nothing we could do about it.
50K + 50K = 100K not 1M you numnuts.
In Australia you don't own the sidewalk or the nature strip out front, the government cut down a tree on our nature strip but there was nothing we could do about it.
While you don't own it, it is your responsibility to maintain the nature strip and side walk. If you do not, you are liable for any damage rather than the council.

1 million + 50K in special damages, such as punitive damages.
Should of made that clear.
Doesn't 50k multiplied by two equal 100k, and not a million?
You should've let the cocksucker slip, then pour salt on him so he doesn't have any place to slip anymore
