Even if the arguments are good and the sidewalk was your fault, the Jury isn't gonna rule with them. And if they do, you need to counter sue. as in sue the lawyer, the judge and the jury (and the actual guy who sued you, maybe) for unlawful shit and slander. Get AS MUCH as you can, might even make it to the news, the judge wouldn't get another job, the jury'd be fucked and the man himself would be publically humiliated and probably be made fun of by 4Chan. Sidewalks are the property of the city, but you do technically have a responsibility to keep your sidewalk free. If, however, the circumstances made it impossible to make your sidewalk not icy (a recent storm, for instance), then you can't be to blame. There's also a law that says you can't sue after x amount of months, but that may only apply to certain insurance laws, so who knows? They won't win that case, dude. It's impossible. Why would his wife even sue? That's ridiculous.

If sidewalk is city property, he's suing the wrong person. If it's private property, sue him for trespassing.

This is all assuming your counter-suing, so when he looks like Ontario's biggest idiot, you gain the trust of the jury and judge. There is no evidence that holds his claim that your mother is accountable to his fall on city property. Scan the papers that were handed to her, lets us see what they're really suing for
