It's a bit different because Konami owns the trademark/copyright for MGS and it's characters. Konami isn't contracted to develop exclusives either.
Sakurai and Kojima are bros, Kojima has a great deal of sway over Konami with Metal Gear, and Twin Snakes was on the GameCube. Remember Kojima wanted Snake in Melee but it was too late in development.
The Smash team probably just liked MGS2 Snake better aesthetically.
