No it doesn't. They're literally just discussing promotional material and who owns the rights to Peter Parker, Spider-man and the Spider-man outfit within a promotional context.
If they put Peter in the film despite not being able to use him in promotion (yet, that will obviously change it's just Marvel being cautious until they understand the rules) they can put the suit in the film too. As if they would have Spider-man with no suit at all. How would they sell action figures!?

i would expect him to have the suit by now though, since civil war is set some time after ant-man, in which he's already known to be doing things.

God I hate that design.
It keeps showing up in every /co/ redesign thread despite how awful it is.
Fingerless gloves that would leave fingerprints everywhere, Hot Topic converse boots that wouldn't allow his feet to stick to walls, goggles and a half-mask that could easily expose his face compared to something simple like a ski mask or balcava.
I know it's supposed to be his first suit, something that a kid made up, but Peter Parker isn't an idiot who values hip fashion sense over practicality.
Also, it's fan-art.
I heard a rumor that the suit we're getting looks like a cosplay suit; it's skintight spandex, looks exactly like an Alex Ross design. Bright, colorful, and a little bit silly. Apparently Tony makes fun of it an offers to make him a "real" suit, but Pete stands by that he likes it.
Obviously to be taken with a grain of salt, but I'd be more than pleased if that turns out to be the case with his design. The design on the hoodie looked like they were headed in the right direction.
Spider-Man is one of those characters that just has a flawless design; he's got cool alts (symbiote, Iron Spider, etc.), but you can't go wrong with the classic red and blue. The key to making a great Spidey suit is to not try to reinvent the wheel. The ASM2 suit was basically a straight adaptation of what was in the comic, and that's why the best parts of that movie is when it's Spider-Man swinging around doing Spider-Man things.

Sorry about that, I was told by someone 3 weeks ago who is usually spot on when it comes to these things that the costume design would be a hoodie sweatshirt with googles and the concept art had already made it's way online.
