I think the US law under which Youtube operates allows third party content with commentary, but not on its own. Then it falls under fair use since it's a review or whatever. Something like that.

It's because RWJ has the most popular channel on youtube, not to mention that he brings them in a ton of revenue. They are more lenient on him because of shit like that.
This guy isn't so youtube is allowed to be harsher on him. It sucks but there isn't much you can do about it.
I think he gets permission from most of the people to use their videos in his videos too, which makes things even weirder.

These videos are compilations which AFAIK aren't covered under fair use. RWJ is using the videos for commentary/criticism.
