the thing is that "drunk sex" means like, three different things It could refer to having sex with someone who's passed out drunk, which I think we can all agree is rape. Having sex with unconscious people is generally defined as rape. Or it could refer to having sex with someone who is drunk. And here's where things get kind of blurry. Like, if you get drunk and agree to fuck someone, I'm not really sure you can classify that as rape. Like, if you choose to get smashed and then choose to fuck someone while smashed, that seems like at least some of the responsibility lies on you. Or it could refer to two drunk people having sex, which I would imagine is what happens most often. I mean, if drunk people can't agree to sex, then does that mean that they raped each other? Are neither of them criminally responsible, or are both of them criminally responsible? This is why I'm not too keen on calling the second example rape.

When you get drunk, you are deliberately impairing your own judgement. As an adult, you're responsible for not drinking more than you can handle. If you do drink more than you can handle and end up doing something stupid because of that, it's your fault. Even if other people should keep you from driving, if you drive while drunk, it's still on you. Dumb decisions you make after choosing to intoxicate yourself are still your decisions. And just from a practical perspective, I really don't see how this whole "can't give consent while inebriated" thing could possibly work. And if you choose to get drunk and then agree to sex, I don't think it could be classified as against your will. A better comparison would be walking into "the hood" and then handing someone your wallet. It doesn't become a mugging just because you realize later on that you probably shouldn't have done it. It is something that should ideally never happen. It's easy to not do, it is a very simple thing. Having sex with a willing person who is drunk is not always bad. There are people who like getting drunk and having sex. In an ideal world, it would still happen because there are people who enjoy doing it and it is not inherently a bad thing to do. You are saying that someone who has sex with any other drunken person should be potentially liable for rape, even if they themselves are drunk. How are they supposed to know if the other person is "too drunk"? If they are too drunk, but the "rapist" doesn't realize it, how are they supposed to prove that they didn't realize it? How are they supposed to prove that they were just as drunk at the time? Do you see the practical problems with what you're proposing? Maybe in an ideal world it'd be nice if people who knowingly take advantage of others were held accountable, but without some sort of omniscient authority monitoring each and every persons thoughts, health, and state of mind at all times, I don't know how you could ever do it in the real world. But what I cosnider drunken sex isn't one person taking advantage of someone who can barely walk let alone stay awake. If both parties are having fun and doing whatever and things get going, then is that considered rape or consent on from both individuals? At that point neither party is forced to engage in sex. The only time one of them would be forced are in circumstances where one of them is clearly in no state of mind to properly function. I'll suggest everyone do exactly what I do to prevent myself from ever committing rape. Everyday, 24/7, I carry around 1 large raw potato. Even when I sleep I keep it on my nightstand. So that in the event that the desire to rape grows, whether in reality or during my dreams, I can eat it and regain my composure. As a white male I can't help it any other way; rape is who I am.
