Jobs usually check your facebook/myspace etc to see if you have a good profile picture and you're not being inappropriate.
This is not an invasion of the 1st amendment, nor any amendments. But more of an invasive procedure of neglecting to realize difference between work and life. They all feel you should love your company, and love your job. Is that so wrong? If you hate where you work, and who you work for, find a new job or keep your mouth shut. Is that so wrong? Them looking at your facebook, and checking your status to see if you're negative, to see if you're corrosive? No, don't like it? Don't do it. Companies would rather employee someone who is good at their job, and is proper. If the job requires qualification, then they'll check that. If not, then they aren't likely going to waste their time. And just because you have free speech doesn't mean it doesn't have repercussions.

Where I live, (Indiana) a boss can fire you and they don't have to give you a reason. So if you have a facebook and they don't like that you have one they can just fire you. It isn't a violation of first amendment rights, and that is where people get in trouble. They think they can say whatever they want and then end up looking like idiots when they get hit with consequences. I am not talking about you, I just mean in general.
I just don't use things like facebook altogether, I think it's pointless.
I guess all it comes down to is watching what you say, and watching out for who's listening...
It's called lifestyle discrimination, and it's completely legal (as of now) in the US. :patriot:
Posting crap on Facebook and getting fired isn't that bad. Posting crap and getting fired in the comments underneath is bad, especially if someone sees it before you can delete it.
Let me be simple as possible with this... Once you walk through your companies doors ,and sign the papers they give you... Your their bitch...

This happens so often, at my work there has been tons of cases of people doing crazy shit and recording it on their phones, now phones are banned at work, its now a firable offense to carry one.

Don't add your boss to facebook or change privacy so they can't see.
Or get a job that you like and stop bitching about it.

On an interesting note, Congress now allows for deployed soldiers to use social networking sites again.
