• Legal question about school? Are they overstepping boundaries?

Jesus, most I've ever heard happen at my school was it was kept till the end of the day. Usually we would just be told to put it away.
lol my teachers didnt even notice my phone was out 90% of the time; only ever got it confiscated once in all my years

For my school they just take it to the office and your parents have to pick it up. After a few times you can either get dropped by the teacher or get Saturday school.

I left it in my locker at gym, and some kid went through with a shim and stole it, so I am more tempted to keep it on me considering I had to pay an 85$ insurance deductible. It takes a bit, considering about 3 people tell me no, and i have to cycle through half of the team for a ride, because most are selfish.

There are probably announcements and news flyers and you've probably been told 24 times not to have your phones on or out during class time and then you're like "WTF man this is Nazi Germany I hate my existence!"
Just pay attention in class, really, as boring and as useless as it might seem now - you'll regret not working hard when you open your results and are disappointed. I learned that the hard way. :smith:

Well we haven't had flyers, we don't have bells, and they recently ran out of money for the test budget, so we don't have an exam in the math class im in (woo!) Our school is under a "reconstruction" basically fixing all the shitty asbestos leaking buildings and trying to make the school a bit more manageable, and under that they have also thrown out some new rules without any information except from the first day of school.

I don't see how you should get in trouble. I'm going to assume outside of the school you're allowed to use the phone, in my school, we were allowed to use it as long as it was after school hours. Just curious.[/QUOTE] Sounds pretty legal to me. It's their policy, the third one is most likely there so you don't actually bother taking your phone out in class. It's like saying "You'll be caned if you get three DUI's." Nobody would drive drunk three times if that were the case, I assure you. But since kids in school are fucking retarded, of course they'll get caught three times and have it taken away for a month.

They can do whatever the fuck they want to, bro. If it bothers you that much, either a.) Don't take your phone out during class/whenever, or b.) don't go to school. Easy/Simple as that.
Also they are giving you the right to use your phone on their property. Would you rather they ban cellphones completely?
There's a way around this, and that's to put the phone in your pocket immediately if you're caught with it. They can't physically touch you so you'll keep your phone, but you'll have to deal with other shit if you do this.
It's legal because you agreed to abide by school policy (including punishments) when you were enrolled. However, I agree, that's a harsh punishment, our school teachers usually just took your phone until the end of that class (if the teacher was a bit more strict they'd take it until the end of the day).

I don't know if you have to give it to them, but they can probably suspend you or even expel you if you refuse to give the phone to them.
