• Legal question about school? Are they overstepping boundaries?

Teachers at my school don't care. If you are just blatantly holding it out there and texting they will just tell you to hide it/put it away.
I don't know if you have to give it to them, but they can probably suspend you or even expel you if you refuse to give the phone to them.
You will probably get in deep shit for insubordination.
It sounds like the laws where you live are shit. If the school tried to take anything of mine I would find another school.
They can't just 'take away' your cell phone, sue them. :v:
At our schools, we're allowed to use our phones in the hall and in the cafeteria. And the teachers never take up phones if you're texting or whatever in class here, they just tell you to put it away. I feel so spoiled :gonk:
You will probably get in deep shit for insubordination.
Stateside, this is exactly what you want. Except for emergency expulsions on Zero [del]Intelligence[/del]Tolerance policies, expulsion on disciplinary grounds without civil charges grants you immunity to the even bigger bullshit like the Becca Bill. Let them escalate and deny you a public education, because then you go to alternative schools for free and graduate 2-3 years sooner. Or just get your gaddamn GED at 16 and be done with it, and pull other shit like four years of free local college off Running Start funding because you were 'home schooled'.
Yeah I think the 30 days is a bit harsh, in our school if you get caught with phone, the official rule is you have to get one of your parents to pick it up, but you can usually persuade most of the teachers to give it back at the end of class.
This pretty much exactly except with a Saturday 4 hour detention

u shuld smoke some dope
Okay, fuck off to the people saying WELL YOU SHOULDN'T USE IT. There's a difference between how I get my phone taken away and how some idiots do. I'm fine if someone sits there texting all class, go ahead and take that. However, my school has taken to seeing students reach to their pocket and look down and subsequently force them to hand it over and give them a suspension. This has happened to me before. I don't currently own a watch, and nor do I have an interest to. I'm not a very social person. I don't contact a lot of people using my mobile phone; it's primarily for emergencies and to contact my parents. I also use it as an alarm clock and, guess what, my watch. I have 8 classes a day along with lunch, and maybe 2 of the rooms have clocks. I rarely check during class, but if I so much as reach to my pocket during the 30 minute lunch period to see how much is left after I ate the first 5 minutes, I get fucking manhandled by the administrators. Hell, I don't have this problem myself, but I keep hearing about people getting their phones taken away because they were SUSPECTED OF HAVING ONE. As in there's a faint outline in their pants or something and they're demanded to empty their pockets and hand it over. In the eventuality that one falls out of a pocket or a bag it gets confiscated. There's also a great little bit in the morning. There's two bells, one to say people should start off to their classes and another to say class is in. The former bell goes off at 7:05. This year, it has been decided that as soon as that bell rings all electronics are away. If I take out my phone to silence it it gets confiscated and I get sent home. People with earphones don't just have to put it away, they get a similar punishment. I'm just whining, but it's still ridiculous. I suppose it's entirely preventable in a way, but in entirely impractical ways usually, such as not carrying one. It just feels draconian what they're doing, like they just want to get us in trouble. The phones and such aren't even much of an obstruction to learning, used more to get the time than anything, and yet the penalty is so great. What's more of an obstruction is the reaction. Meh, doesn't help I expertly rage when something ridiculous happens and some asshole just goes HURR DURR YOUR FAULT THEY TOLD YOU DON'T CARRY A PHONE ASSHOLE when they'd be just as angry in a similar situation.
I'm going to bet it'd be hard to get a job with that.
Getting a GED is basically screaming to any employer "I dropped out of high school because I couldn't handle it." So yeah, you're right.
Yep, I don't know any lawyers and I am just curious about this new "rule" they enforced. Get caught with phone out, take it for 2 hours. Get caught 2nd time, they take it for 1 day. Get caught a 3rd time, They take it for 30 days, And after that I'm not sure how long they take it. Now this is spread over a period of 180 days, so if I have it out the 2nd day, and 2 more times over that, they take it for 30 days. My question is it legal for them to take the cell phone for that long of a period of time, considering I bought my phone, and work to pay for the monthly plan? Just curious.
Yep it is legal. Their grounds their rules, if you read the student code of conduct it might be in there. I know when I was in school it was in there. It isn't really "Stealing" because you surrendered the phone freely to them, sure you didn't like it but nonetheless you surrendered it under that term. I'm sure If you go to the office and speak to someone you can handle it reasonably. I don't see why they wouldn't. Though that is if it is within reasonable terms, IE Texting during class or school hours. Though your parents can ask for it back seeing as it is your property, though it might just be a smart thing to keep your phone off during school if you have a problem with texting. Though after re-reading some of your posts, if they tell you to surrender the phone because you just reached in to your pocket then that is a problem. If that happened too me I would politely tell them to fuck off and go do something useful.
I feel bad for you guys, our school actually just implemented a new rule that allows us to call/text/whatever with our phones in the school commons, lunchroom, and outside. You could probably get away with it in the halls too really if you wanted to. OP, just go to the bathroom whenever you need to check your phone?
Getting a GED is basically screaming to any employer "I dropped out of high school because I couldn't handle it." So yeah, you're right.
Except for that part about having two years of college down at nineteen. Any employer that takes a High School Diploma seriously is not the type of organization that pays well, if you know what I mean.

If you don't give them anything, they have to take it... which they can't. They will try though. Just be polite and persistant and victory is assured.
Was the question "Can teachers your phone in class?".
I never my phone in class.
If our phone gets taken away they keep it until the next Friday, and your parent has to come get it after school hours. Just stop fucking with your phone, really.
School is getting more whack. They go off campus in golf carts looking for kids, Yet it is not their jurisdiction yet they still do it anyway.
School is getting more whack. They go off campus in golf carts looking for kids, Yet it is not their jurisdiction yet they still do it anyway.
Actually that's for their own benefit, if they end up with someone injured or killed when they were meant to be in school, the school gets fined and blamed, so it's in their best interests for students to stay on site. And about phones, they're in their legal rights to do so, plus it's your own fault for having your phone out when it shouldn't. You know the rules, and so do they. Stick to them.
if its written down as a rule, follow it. How hard is it to keep the vibration in your pants!
if its written down as a rule, follow it. How hard is it to keep the vibration in your pants!
Turn it off.
Put it in your damn locker if you're in highschool That was the rule at my school, everyone followed it pretty well throughout every year. You kept your phone in your locker during school hours, free to use it anywhere after wards.
Mine isn't as harsh, we actually can use them at lunch. Alot of people still use them in class.
Mine is like this 1st - get it at the end of the day 2nd - get it at the end of the day. etcetera.
i am in college so you are completely allowed to use your phone at any time, leave class, not go to class, listen to your ipod, use your laptop during class, call the teacher by their first name, and have an opinion or unique point of view on anything that you want peace out.
At least you don't get flogged.

You're fucking lucky. At my school, they take it and you have to pay to get it back. First offense: $25 Second offense: $50 Third offense: $50 and a parent meeting
