Legal question about school? Are they overstepping boundaries?

I would have stopped having my phone out
I'm pretty sure that's illegal.
It's legal, it's their own property and they can do whatever they like if you're breaking restrictions that they have placed.
School is getting more whack. They go off campus in golf carts looking for kids, Yet it is not their jurisdiction yet they still do it anyway.
The school is your legal guardian during school hours so they can do this.
But what you're all forgetting is that the school can't make you do anything. You still have free will, you may just have to deal with the consequences if you exercise it. (And being a stubborn ass on principle DOES have its place, at times. Being able to identify appropriate times to question authority is a fantastic skill to have.)
The school can do whatever they want. You have no rights in the building so there rules are final.
Yes, schools dont dont follow by the rules of society exactly. They're allowed to be a little more strict.

You have rights, you can just be punished for exercising them.
Okay, fuck off to the people saying WELL YOU SHOULDN'T USE IT. There's a difference between how I get my phone taken away and how some idiots do. I'm fine if someone sits there texting all class, go ahead and take that. However, my school has taken to seeing students reach to their pocket and look down and subsequently force them to hand it over and give them a suspension.
This has happened to me before. I don't currently own a watch, and nor do I have an interest to. I'm not a very social person. I don't contact a lot of people using my mobile phone; it's primarily for emergencies and to contact my parents. I also use it as an alarm clock and, guess what, my watch. I have 8 classes a day along with lunch, and maybe 2 of the rooms have clocks. I rarely check during class, but if I so much as reach to my pocket during the 30 minute lunch period to see how much is left after I ate the first 5 minutes, I get fucking manhandled by the administrators.
Hell, I don't have this problem myself, but I keep hearing about people getting their phones taken away because they were SUSPECTED OF HAVING ONE. As in there's a faint outline in their pants or something and they're demanded to empty their pockets and hand it over. In the eventuality that one falls out of a pocket or a bag it gets confiscated. There's also a great little bit in the morning. There's two bells, one to say people should start off to their classes and another to say class is in. The former bell goes off at 7:05. This year, it has been decided that as soon as that bell rings all electronics are away. If I take out my phone to silence it it gets confiscated and I get sent home. People with earphones don't just have to put it away, they get a similar punishment.
I'm just whining, but it's still ridiculous. I suppose it's entirely preventable in a way, but in entirely impractical ways usually, such as not carrying one. It just feels draconian what they're doing, like they just want to get us in trouble. The phones and such aren't even much of an obstruction to learning, used more to get the time than anything, and yet the penalty is so great. What's more of an obstruction is the reaction. Meh, doesn't help I expertly rage when something ridiculous happens and some asshole just goes HURR DURR YOUR FAULT THEY TOLD YOU DON'T CARRY A PHONE ASSHOLE when they'd be just as angry in a similar situation.
Don't use the phone in school.
Bunch of fucking whiners, when my parents went to school, teachers smacked them around when they misbehaved. They should start doing that again.
Minors/dependencies have no rights.
You think that's bad?
At my old high school, get caught with it out once, and it's taken away.
They then sell it for profit, file a report with police to fine you $200 for interference of schooling, and if not paid, you get arrested, expelled from school, and have to pay $500 on top of the $200 for being "difficult". And this was a public school. Key word, WAS. I filed a lawsuit and won. Yes, I'm an asshole, but schools are full of even worse assholes of so called "authority".

No they shouldn't, those times were horrible, the teachers would just hit the fat kid for being fat all the time and then hit everyone else.
If you wanna live in such a barbaric way, stop, this causes more problems than it fixes.
Can someone find me a page in the constitution that says or even remotely IMPLIES that minors have no rights?
You know that minors are humans too, and adults aren't magically SO much more important than them

I bet you never took your phone out when you shouldn't have after that.

And now that's called child abuse because minors got rights
My school suspends you for a day if they see any sort of electronic device at all.
It's because kids don't know the difference between right and wrong. Kids do stupid things. So they don't let Kids have rights until they've gained enough experience to, well, level up basically to a more mature state of mind.
It's not actually written anywhere, but it's just the done thing that's been done by society since the dawn of time.

Well saying they have like "no rights at all" is just plain dumb, they do
Well saying they have like "no rights at all" is just plain dumb, they do
Your guardians are your representatives, they are to look after you, they are your rights, if you think it's plain dumb that you don't have freedom, try bringing yourself up without any guidance or rules to keep you in line and protected.
A hall monitor took my phone away for 2 minutes when there were 4 minutes left until 3:00.
I was walking from the bathroom to my locker and just barely took it out of my pocket to turn it on for the end of the day and for some reason
she found it necessary to hold it and have me stand there next to her.
[editline]herp[/editline]
I wasn't particularly bothered by it, but I just don't know why the fuck any adult would see any point to doing that.

If you can't do the time, don't do the crime.
It's the best advice anyone can ever give you.

So you'd rather have your phone taken away than using a watch? :downs:
Get a watch, I have one on me 24/7, it's pretty much one of the handiest things ever

No, they're on your wrist, not your hand.

You would have a point if it were the middle of the day.
There was no real reason for her to take it away other than to arbitrarily enforce the rules.
I mean come on, it's not like I was in class or even in between classes, I was leaving the school.
No, they're on your wrist, not your hand.
I meant handy as in useful
God I feel so lucky now.
First offense - Depending on teacher, either end of day or class period.
Second - Until parents take it up, which is usually pretty quick.
And really, parents can demand anything they want back. When I have kids one day, I'm gonna use that against the "June Box" that they used to do.

I believe that may have been a joke.
School is for learning. Not for fucking around with your phone.

Rules are rules, if they make exceptions then the whole system breaks.
I worked for my school during my senior year and had a teacher take away my school owned phone and 2 way. She figured out quiet quickly that I will call my supervisor and put her in a world of shit. she learned to not fuck with me after that lol.
My school takes the phone away until the end of the school year the second time they see it out, you have nothing to worry about with your school. :/
