You need a permit to protest inner city- a protest that has no permit is un-permitted? First amendment or not, the fact that you're blatantly disobeying police orders that are being broadcast from helicopters and every loud hailer in the area indicates to the police that you know the consequences of staying. So please don't try to justify the actions of the people in the video, they were clearly in disobedience.

It seems to me that majority of damage in this debacle was done by one David Japenga, whom broke $20,000 worth of windows. I'm sure that after he was taken down that there was more then an opportunity for the rest of the give or take 4,500 protesters to freak out and go "mob mentality" Which they didn't. I still think it's pretty crap-tastic that a bunch of people were traped and gassed like that.
To be honest I feel more sorry for the riot police. The reason most beatings and such happen in riots is because the riot police have been attacked with bottles etc, and been forced to stand there and do nothing. If you had moronic kids throwing shit at you for 5-10 minutes, I think you'd want to beat the crap out of them. It's funny because in every video the police say at the start that unless they disperse, police action will be taken.
