Petition won't work because it's not about public support, this isn't a democracy and it doesn't really matter how many of us don't like it.
As for him getting unbanned, it seems pretty likely in the long term actually, he was a valued member and did nothing particularly banworthy except say the wrong thing in a potent thread. Give it a month or two and there will be some progress, keep them as an Avatar for a reminder but don't expect immediate action.

The First Amendment doesn't apply to private websites. If you agree to the TOS, you're bound to the TOS, unless the TOS itself is illegal or something. I dunno.
But yeah, as ridiculous as his ban situation is, the First Amendment isn't gonna save him here.
Personally, seing as Lankist is a Mexican, his ban can be interpreted as "Come get us you pricks" rather than "Mexicans are stab happy".
