Is a negative declaratory judgment possible in the US in case Bold Guy backs out? Not sure if its just a thing here in Germany.

Imagine being Bold Guy in this scenario. All these big names most people look up to rallying in support of the guy you're suing out of greed and pettiness. And you're virtually guaranteed to lose the case and pay up all the legal fees. Gonna take some legendary mental acrobatics to come out from that with your ego intact. Though I don't think he's adept at acrobatics of any level at this point considering he's hit his head pretty severly according to what he says

Not sure if its just a thing here in Germany.[/QUOTE] How it works in the US is that you can get a declaratory judgement as long as you have the legal threats towards you in writing, unless you receive a covenant from the guy bringing the lawsuit that states not only that you will never be sued in this instance, but that you will never be sued by the litigating party ever. Though this is highly dependent on how important the judge thinks the case is.

Honestly at this point I don't even think they'll have to "win" the case, unless Bold Guy has some sort of secret funding I can't imagine he'll be able to afford to see the suit to it's conclusion if his costs will be anything close to h3h3's.

I almost want to say he's probably enjoying all this attention, before I remember shit like the guy spamming Matt's phone number and address all over Matt's facebook page and everywhere else lol. I gotta wonder tho if Matt's gonna use all this harassment he's now getting as ammo for the court case, like claim it was all H3H3's doing or something.

You know that Bold Guy is just going to use this video and the reactions as more fuel for his case. Not saying that it could improve his chances of winning, but it could definitely drag the trial out even longer (assuming it doesn't get thrown out). Ethan and Hila must have really needed to vent this out. I can't imagine what it's like to wake up, go to your computer, and get an email that basically says, "Hey, I'm going to put your entire life and career in jeopardy because you said mean words about me."

You have to remember that they have a massive interest in H3H3 winning this case. I'm not trying to shit on them here, but it is true that if H3H3, their entire method of content creation is probably screwed.
