I understand that, but as quite possibly the biggest personality on the internet, he has a responsibility that most other immature gamers dont. He should be well aware of what that word means considering his presence online, and my guess is that he is aware considering his immediate reaction to saying it.
Even more concerning is that he responded by saying "Sometimes I forget that I'm streaming" and has been calling it a "slip up", which to me, implies that this isnt the first time he's used this so flippantly.
I wouldn't be surprised if he just gets more support online for this, though. I'd wager that a good chunk of his fanbase are teens that act the same way online. I've been around the type throughout my public school days, it's not anything rare. But considering that he's what, 27 now? It's pretty unbecoming.

Is there any particular reason people are acting like this specific abuse of the DMCA system on youtube will result in legal ramifications when, to the best of my knowledge, that has yet to really ever be the case?

Something of a similar kind of thing happened fairly recently in regards to Alex Mauer, and H3H3 just won their own DMCA lawsuit, so the likelihood of this being contested might be way higher than before.
Like if Pewdiepie actually got the DMCA, and went "uh, no, fuck off", he'd probably win at this rate.

It's still murky territory so a ruling can really go either way. Fair use isn't a catch-all in this situation. It's a defense, but they're not 100% protected.
