Because Jim is disingenuous. He isn't acting in anyone's best interest but his own. Fighting Digital Homicide wasn't for anyone but himself, it wasn't about fair use or anything to him. When he points out a dev doing something he thinks is "naughty" he's just doing it to get a gravy train going.

Ironically, this whole debacle kind of shows who cares more about money and pandering than being able to be themselves when playing video games.

If you listen to his podcast (No specific episode, just in general) you'll see why he does. He's pretty hyper against anything similar to this really.

LP not being fair use is insane because watching and playing are game are massively different. They aren't even slightly the same experience.

I'm not agreeing with Jim, I just interpreted it as him suggesting that Pewdiepie's overexposure (due to him being a 'big YT celebrity' and an easy target) will make things harder for the rest of YouTube.
But that's entirely on the journalists who choose to react towards these kind of things. I wouldn't blame Felix for the issues, since I think how easily it is to abuse YouTube's system is the bigger issue, as well as the never-ending cycle of media forms that are losing relevancy and unable to adapt choosing to run smear campaigns against the new media forms which are taking their place.
Pewdiepie is just the poster-boy that they choose to harass since, even if he's not a representative of the vast YouTube community, he is one of the faces of the platform by subscriptions alone. Journalists and game developers know that they can use his numbers in their articles as reasons to why the platform/LP-genre as a whole "is rewarding racism and bigotry," and they know they'll get a rise out of him.
Jim is thinking of the short-term effects, where this could lead to another wave of journalists and now game developers turning their backs on the YouTube platform just like advertisers had. Those could also have very long-term effects if devs start reading and believing that "YouTube's top gamer is a racist, therefor all YouTube gaming is racist." But, considering the spontaneous reaction to the Firewatch guys, I highly doubt that much long-term harm will come of this specific incident.
if LP's are not fair use, then streams aren't either. And if neither are? Twitch might as well not even exist, neither should a massive amount of youtube content.
Game grumps, oneyplays, jimpressions, markiplier, and an uncountable list of streamers and other LPers? every single one of those are not legal. dump them all, can't be defended in court.
That's what would be possible if we go by that lawyers ruling. I'm willing to bet he thinks its no different than a movie.

I don't think he's right to blame Felix like this, but if you look at it from his content creator point of view, every time Felix says some racist shit the whole youtube and gaming community pays the price. You obviously can't blame the adpocalypse on Felix, but if he throws easy bones all of the time at people who want to paint him and everyone like him a racist. I watched hundreds of his videos back in the day and I absolutely don't think he's racist, just out of touch.
He doesn't realise that for [I]many[/I] people who are not familiar with gaming, he's the face of gamers on youtube, and the dumb shit he said has been used to harm the reputation of everyone else and I think that's what Jim is saying here.

In PUBG when everybody else practically chants it at the start of the game it is pretty much a sub-conscious time bomb on saying it.
Hell, I have used it in in-game chat just because it is like the culture of PUBG to do so. Even though I otherwise never use it outside that context.
Pewdiepie as far as I know has, so I am not surprised he would randomly blurb it out, but Idubbz also says it alot intentionally and he isn't getting burned on pyre by other youtubers.

As someone who plays more video games than anyone else I know, and who has over 1000 games on Steam/GOG, I will readily admit that video game culture can be really toxic.

Personal Opinion.
I wouldn't want my video games any other way. It is quite nice to "unload" and take a break from my normal social cues to just be random with anonymous people online.
