I believe what they are saying is that if you are speaking to a person you don't know, you are responsible for what you reveal and what gets out. Thus, you should treat it as 'public'. They won't be held accountable if you fuck up and ruin your life by sharing something illegal and getting reported by another member.

Yeah I guess I can't regard steam as a private place to talk anymore, unless I use voice chat, which sucks.
Of course I doubt authorities will bother trying to get information from steam unless it's something really severe like terrorism or treason, but you can never be sure.
