I don't see how your wife cheating on you counts as reasonable provocation. How is that an excuse to kill someone?
Terrible laws which luckily don't exist.
anymore of course.
and a jury with the combined IQ of a fucking pine cone.
it's not the jury's fault. the law had a defense of provocation strictly defined. the defense was able to prove provocation according to that definition, then the jury cannot find him guilty of murder. shocking, but the fact that the jury must follow the law down to the letter is one of the simplest safeguards in the judicial system.
I don't see how your wife cheating on you counts as reasonable provocation. [editline]9th July 2011[/editline] What would have happened if the prosecution had appealed the case after the provocation defense was thrown out? From what you guys are saying, should have appealed anyway.
Doesn't prove he was planning murder. Could've been expecting all kinds of shit he wouldn't want that guy to see.
regardless, the fact that it resulted in a "fit of rage" would be enough to satisfy the requirements for a murder conviction (now). [editline]9th July 2011[/editline]
What would have happened if the prosecution had appealed the case after the provocation defense was thrown out?
they appeal, and the prosecution is successful, they set a legal standard that allows anyone to appeal their conviction based on changes in law.
they appeal, and the prosecution is successful, they set a legal standard that allows anyone to appeal their conviction based on changes in law.
A legal standard that can be easily disapproved of, or even entirely removed.
A legal standard that can be easily disapproved of
then what would've been the point in appealing it?
Adelaide is gay because it is famous for having touching balls
Balls of steel?
That touch..
If your balls dont touch you should really see a doctor. Now if they touch other balls, on the other hand..
Hi all, just got a question about the return date. It's the 18th, not the 11th. I thought you guys were told about it, but just in case. The reason being we had a change of bosses and needed the extra week to sort stuff out.
Thought semester break was ending tomorrow, turns out I get an extra week making it a 4 week semester break. This is great because I don't have to fuck around with the sydnem line being down till the 18, rail bus's are crap

Oh god, in 8 hours time I can find out whether or not I passed biology. Pleeeeaaaaase be a pass mark. I don't want to have to do that all over again. If I fail that shit I'll pick it up as a summer class and do it then. Don't want to sacrifice my change to pick up an interesting elective because bio sucks.
Biology is fucking awesome [editline]11th July 2011[/editline] and easy
this house is for sale: http://maps.google.com.au/maps?q=4+delmont+avenue+altona&hl=en&ll=-37.861304,144.814965&spn=0.000921,0.002064&sll=-37.866181,144.821777&sspn=0.117223,0.264187&gl=au&t=h&z=20
I went to primary school, 2 high schools and now work near there.
HOLY FUCK! I PASSED! SOMEHOW I PASSED! 60 IN BIO! WOO! Got Credit in bio, Distinctions in both Chem and Scientific Skills and Communications, and got High Distinctions in physics (no surprise there).
Biology is fucking awesome [editline]11th July 2011[/editline] and easy
Bio is easy if you have a good memory, because that's all that biology fucking is - memorising facts and ridiculously long cycles and names. I mean how the fuck am I meant to remember every single step in the electron transfer chain AND in the citric acid cycle AND in god knows how many other things? Physics and chem are easy to me. Memorise a few small equations and BAM you've essentially got the subject nailed.
You got higher in Bio than I did. First philosophy class was complete mindfuck.
I wouldn't mind doing philosophy but I'd probably be a little too forceful with it. Also it'd be like watching a game show in that I yell out all the answers, just like when I read Plato's Republic.
