No it's the new design for Warmachines new suit. Originally people thought it would be Iron Patriot, but that character is Normon Osbourne (The Green Goblin) so they don't have the rights to him.

Sony owns the movie licenses for all things related to spider-man.
Same reason Marvel Studios cant use any X-Men or Fantastic Four characters or Daredevil, their movie rights are owned by Fox.
Actually Daredevil is apparently back at Marvel along with The Kingpin.

To be fair it [I]could[/I] be Norman but I doubt it. Oscorp was going to appear in Avengers and Stark Tower in Amazing Spiderman and they had the CG models all ready but ran out of time.

There is literally no other reason Andrew Garfield would have a huge fucking stack of Avengers comic specifically about Thanos unless it's actor research.

Plus Spidey being in Avengers would literally make the film explode at the box office. And then the next Amazing Spiderman would get a shot in the arm with attention too. I am sorta expecting some sort of cameo or reference at the end of AS2 now as it should be out before Avengers.
That'd be cool to see Spidey in The Avengers 2, but I am pretty doubtful since there was no mention of The Avengers themselves in The Amazing Spiderman.

Apparently you can help Iron Man 3 trailer get released earlier. Marvel released a Facebook app thingy to help recharge Tony's Arc reactor, once it's fully recharged the trailer will be released.
