• The "No Tolerance" Policy at Schools

My high school has a similar policy about aspirin. In the Student Handbook it says students are NOT allowed to bring any medications to school unless cleared through the administration and the school nurse. The handbook specifies that "medications" includes OTC medicines, including aspirin. Honestly, it's fucking stupid. I can understand why they wouldn't want anyone to bring prescription drugs (especially ones to treat ADD, since most drugs that "treat" ADD are considered "controlled substances" and stimulants), but aspirin... the story about the 14 year old girl who was stripped of her clothing and touched inappropriately all to find an alleged bottle of aspirin comes to mind. If someone were to strip a 14 year old girl of her clothing and feel up and down her body, he'd be in jail in a heartbeat, right? Nope. The school nurse and administration of a Pennsylvania high school traumatized this girl to find a bottle of aspirin (which was never found). But the girl sued and won, and I believe it resulted in a Supreme Court ruling pertaining to the legality of strip searching in schools. But guess what? It doesn't fucking matter if you had that aspirin for emergencies, or if you have migraines, or whatever your excuse is. If you have it, your automatically guilty, due process need not apply. Zero Tolerance is a result of the one thing that American culture seems to crave; they crave it more than a junkie who hasn't had his fix: [b][highlight]FEAR[/highlight][/b]. Americans always have to fear something. Weather it's illegal immigrants, terrorism, school shootings, African bees, Anthrax, the Soviet Union, the Swine Flu, you name it, America's afraid of it. And yes, African bees was as scary and dangerous as the Swine Flu once apon a time. Anyone whose seen the film "Bowling for Columbine" should know this. For a long time, America feared that Africanized Honey Bees would come and kill us all. You know what else America was terrified about in the '80's? OH FUCK THE DEVIL IS INFECTING OUR YOUTH WITH THE WORDS OF THE DEVIL HIMSELF!!!") to Dungeons & Dragons, even Goth culture was claimed to be a massive conspiracy to infect the minds of the youth with the Devil's teachings. You can't make this shit up. Unfortunately, this madness has spread to public schools and collage campuses all across America. These days, anything can be interpreted as a terroristic threat, sexual harassment (kindergartens, even). Electronic belts? OSHI- ITS A FUCKING BOMB! DON'T MOVE OR WE'LL SHOOT! Small LED display panels that show Aqua Teen Hunger Force characters? "IT'S A FUCKING BOMB! LOCK DOWN EVERY STREET IN BOSTON, WE'RE UNDER ATTACK!" Anthrax that killed, what was it, 6 people? "HOLY SHIT DON'T OPEN YOUR MAIL YOU COULD DIE!" I seriously remember not opening any mail for a month because I thought I'd die. Unfortunately that's the culture Americans have accepted. Everything is dangerous. Fear everything. Do nothing. I do, however, have a tip for the OP: Assuming your in high school, you should have a copy of your state's Driver's Manual. In it, there should be a section detailing an "Emergency Survival Kit" - stuff you should have in your car in the event that you become stranded in the middle of nowhere, on a freeway, in a blizzard, etc. It should recommend that you have, in addition to things like flashlights, blankets, and flares, a bottle of aspirin or another OTC pain reliever. Show that to the principle and say you simply followed the instructions your state prepared for you for safe driving. Since schools that institute "No Tolerance" policies claim to be so damn concerned about your safety, they should let you off the hook.
Wait...Aspirin? I'm fairly sure you can't even get fucked up on that stuff.
For the aspirin thing They can't tell if you are giving it to someone else, using it for yourself, obeying the recommended dosage, or even if it is actually aspirin, among other reasons.

They can begin a search of your belongings (backpack, bags, pockets) due to "Reasonable Suspicion". If you don't comply, it's simply a matter of getting the resident police officer, which almost every school that I know of has. At this point they can search your car. The law keeps drunk driving teachers working, drunk driving teacher's son's on the football team when caught with Marijuana on campus (twice), but punishes people for the use of aspirin (A substance which is almost guaranteed to be completely harmless, even if you take the whole bottle.) If you wanted to have aspirin available to you at school, you needed a note, and your parents had to deliver the aspirin to the nurse, who had to keep it locked up until you needed it. To get the aspirin, when you needed it, you had to interrupt class, get a hall pass, thus pissing off the anal teachers who might even deny giving you a hall pass, then go through the process of obtaining the aspirin from the nurse, who usually had to call your parents to confirm that you could take it that day.

Oh man, I'm glad I've never had to get searched. One day, I was digging through my backpack, and I found an old cold medication tablet from grade school. Good 5+ years just sitting in my backpack.
How stupid. The school and government has gone soft, they don't want to be held liable and are paranoid about law suits I guess.

But the law is clear on what reasonable suspicion is. Just because someone is a teenager or discusses drugs, it is not grounds for reasonable suspicion. And if they want to search, they can only search where they are told drugs might be. They can't search your car, your house, your locker at the 24hr gym.

The United States Supreme Court ruled in the 1925 case of Carroll v. United States that a police officer can search a motor vehicle without a warrant as long as probable cause exists. Since then there have been other rulings by the U.S. Supreme Court and state courts that have modified the original decision a bit, but it still stands. It's perfectly legal to search a motor vehicle without a warrant.

First of all, the Office is not allowed to touch any of your possessions unless you let them. Second of all "handing out pills at the local park." is not grounds for a vehicle search.

That is enough probable cause to justify a search of a motor vehicle. Unjust? Yes. Legal? Yes. However, if the OP wants to get out of trouble, my post on the previous page offers a great hint to justify carrying aspirin in his car.
Why the hell would you let them search you? Even if the law doe's allow them to you should still take a stand for your rights, because if you don't I can only imagine the shit our next generation will deal with. Just because you don't have a reason to hide doesn't mean you shouldn't care.
Its also your fault. The law is "Students are not allowed to have ANY medications on campus including over the counter drugs, Prescription medicine, Cough Drops, etc." EDIT: Unless said student provides a doctors note.
