There are always shades of grey when it comes to crime and I thing this case is far enough away from raping at gunpoint that it should be considered a different crime. But at least we agree on it being inexcusable and society needing to be made aware that this is a problem.

Yeah it's not as bad as getting violently held down or even beaten up and forcibly fucked, but it doesn't change the fact that it's still rape and should be treated as such. However I believe it is very hard to tell when someone is giving you consent without them explicitly doing so, so for the sake of not violating their wishes and for the sake of not making yourself a criminal you should always ask for a clear yes or no response. However once consent is given it's up to the person who gave it to revoke it just as clearly as they gave it, to not expect the person who they gave consent to, to be able to read their implicit revocation of consent.
