Maya used to be more animation oriented while 3ds max was more of the 3d modelling package, now they're pretty much the same in terms of capabilities but you can achieve certain objectives faster with one rather than the other. In the end it's more a matter of preference than anything, I personally like Maya more.

I hear ketchup too when someone says sketchup. As for max vs maya, they're both good. It depends on what you want to do. Also to me maya is more stable, but that's just my shitty notebook.

FP white background+your white gun= my eyes are burning
Yea a slightly darker gray, or even something like tan would be less burning.... That's what I normally use when making a render like that.
Needs contrast on the render, so use darker colors for one of them, or the weapon or the background, one of them must be darker.

Why is there an outline?
The outline makes it look like a gun from Borderlands. Good modeling though, looks great.
There is an outline because I wasn't sure how bright it would turn out.

Looks really good even not following exactly the reference.

Anyways, I added simple interior rooms, updated the lighting, messed with some materials, (If you look the brick material is quite cruddy looking, I've yet to UV the building), and made the view closer to the reference for better comparison.
