Anyone thats renting, some of you might be covered by the TDS (tenancy deposit scheme). Basically a 3rd party that deals with disputes when it comes to the end of it all. My landlord tried charging me and my 3 housemates £3,000 and making a long list of bullshit that when added up comes to about £2,000. Thankfully the estate agents had a inventory check (guy photographs/assesses the entire house) done beforehand. This was also done when we moved out so I could compare the 2 and go "We aren't paying this because the house is in the same state as when we moved in". Oh yeah, clean the house before you move out. Especially the bathroom and the kitchen sink. So we let the landlord and estate agent that we want to use the TDS to assess the whole thing and they quickly send an e-mail getting an account of what the landlord thinks we owe and why. Then what we think the landlord wants of us and if we think its acceptable. The site for the TDS allowed me to see what the landlord put up since she filled her stuff in first and it ends up being different to what she initially moaned about. I use this to my advantage and, using both inventory checks fulled with photos as proof, disprove every single point she made. Also added her previous claims as evidence that the demands changed from £3,000 down to around £1,000. After all this was submitted it gets checked over independently and assessed. Only had to pay £160 in the end because of a burn mark on the kitchen counter and a missing lamp. Make sure it's covered from the start though but I think most rent agreements are.

Don't rely on the estate agents though, they're a bunch of incompetents who generally cant be bothered, I've had several done and in more than one case the colour of the carpet wasnt even stated correctly and descriptions werent matched with the correct room photos etc which would totally invalidate your proof. If they say theyre going to do it, make sure you get a copy and make sure it is correct - they should ask you to sign it and refuse to unless it is correct - I've had to do this repeatedly one particularly bad estate agent (Surelet Derby) needed 3 attempts to list a cream carpet correctly.

Their office was across the road though so they where alright for getting stuff done. They did try giving us all the pictures in black and white originally but that was quickly sorted. Another important point, make sure that you both understand what "wear and tear" means. You're well within your rights to not have to cover something that is old and should be due to be replaced.

My last landlord clearly didn't have it in the scheme and I just kept quiet about it. If he was gonna be a dodgy dave about deductions even though we very thoroughly cleaned the house then I could just bring up the fact and he'd probably roll over rather than risking paying tons more after legal action. Estate agencies are completely useless 99% of the time though. Their 'inventories' are usually outdated or very inaccurate, not detailing things they would charge you for if they spotted them when you moved out. The only thing they seem to care about is if you don't pay your rent on time, then they suddenly become very good communicators. Best advice is to take pictures of everything upon moving in as well as upon leaving. You could also either ask the agency to agree on and sign an updated inventory (Assuming they keep an inventory) with all of the issues they missed amended, or if no inventory at least email them before/the day you move in with a list of issues and pictures that you want on the record, then at least you have that in writing if you need to refer to it. You're well within your rights to not have to cover something that is old and should be due to be replaced.[/QUOTE] Wear and tear, 'professional cleaning upon moving out' etc clauses are the biggest cause of bullshit deposit disputes and the reason people need to jump through all these hoops just to protect themselves in the first place. Just remember that if you decide to use an adjudicator to resolve a deposit dispute, the odds are in your favor as the deposit is considered yours and the onus is entirely on the landlord to prove within reasonable doubt that you owe them for something.
