It's bringing in a lot of publicity (and increased sales for XY) and actual mainstream attention, so they would have to know about this by now. They'd be crazy if they went and shut it down.
Also, aren't roms legal if you own the actual game.?

Found the right section you were intending to lead us to. I accidentally read the one below it regarding emulators. "There is a good deal of misinformation on the Internet regarding the backup/archival copy exception. It is not a "second copy" rule and is often mistakenly cited for the proposition that if you have one lawful copy of a copyrighted work, you are entitled to have a second copy of the copyrighted work even if that second copy is an infringing copy. The backup/archival copy exception is a very narrow limitation relating to a copy being made by the rightful owner of an authentic game to ensure he or she has one in the event of damage or destruction of the authentic. Therefore, whether you have an authentic game or not, or whether you have possession of a Nintendo ROM for a limited amount of time, i.e. 24 hours, it is illegal to download and play a Nintendo ROM from the Internet." Basically what this is saying is when you buy a game you are merely renting that specific copy. You don't actually own the game and legally cannot make duplicates even if you intend to keep them to yourself. I find this to be a childish form of copyright law as backups are our way of feeling secure when it comes to our property. I strongly believe that if you spend money on it and have it in any form be it a copy you can hold in your hands or a digital copy from the official store that it is yours and that you can do whatever you want with that copy. If that copy is damaged and is no longer functional I also believe that you should be able to use a backed up copy to replace it rather than being forced to spend your hard earned money on another. With that being said, this stream is a well known one. Nintendo surely knows of it and the fact that they've done nothing to cut the stream can only mean one thing. They are hypocrites.

In Germany at least Roms are illegal, even if you own the original game IF YOU DOWNLOAD THEM.
