I like the skill tree thing with the perks
but I still would rather prefer a regular old XP system

I'm not sure about you, but I wouldn't put trivial things like animations at the top of my priority list when making a big game. I would probably put important things like gameplay and combat first.

They don't even seem that unfinished. The most unfinished thing that was in the demo was that waterfall (Which I do actually hope they touch up a lot. I know there will still be mods to make it blend in better with the rest of the water and look generally less shit, but still, it was bad enough that it shut up the crowd that was excited by the player character swinging his sword at the air), everything else looked pretty much golden, especially considering how much other shit they had to make in the game. If anything, as dvondrake said, the player character's walking animation has a surprising amount of fluidity, subtlety and attention to detail for just about any game, let alone a Bethesda-developed game.
Although I do have to admit that they really need to add some small amount of head bobbing, or some kind of subtle, idle movement with the first person camera. I don't really notice it that much in-game, but it still looks like the first person camera is literally just a camera on wheels, which does admittedly detract from the immersion somewhat. Although there are always mods for small things like that (Even though I have the feeling that most mods like that will really overdo the head bobbing).

What makes the games so good? Is it the gameplay? The freedom? Modding?

They're massive, mostly well written, fun games. You're pretty much able to make your character however you want them to be and the amount of content in the games can last you weeks. And even more time can be added from mods since the game has great mod capability. The mod community has made (among alot of anime stuff), extra quests, locations, armor, weaponry, clothing, hair models, tons of stuff.
If you don't like RPG's you obviously wouldn't like the games, but if you can stand them they are fantastic games.
