Another thing I have seen on some news articles: "The press release states the Millers later admitted to the crime, and detectives overseeing the case believes that "it is apparent from the video, combined with the interviews of the Millers, that they were tired of their neighbor, Aaron Howard, acting out and yelling and threatening them verbally." This makes me wonder if this was a reoccurring theme.

Sure. The thing is weapons are unable to enact their purpose without a user. The vast majority of weapons have never been used to end someone's life and for the most part weapons are used as a show of force. Most gun related incidents end with no one getting shot. In this case, sadly it ended horribly. A weapon is a tool, and even still you can't blame it. By this logic cigarettes were a mistake. They kill nearly 14 times as many people (480,000 to approximately 35,000 with 2/3rds being suicides mind you.), and yet all you need to purchase something that kills 41,000 people annually by second hand smoke alone is to be 21 or 18 in some places. I don't smoke, but if it helps other's get through their day who am I to judge? You cannot blame inanimate objects for their owner's mishandling. That's just silly.

It's complicated. Long story short, because of the way the NFA is written, it gets away with it by not having a stock. More details here regarding a similar firearm recently introduced to the market.

Because even though they have a 14" barrel their overall length thanks to the pirate grip makes them greater than 26". The overall length of a firearm is distinct when you get over 26", as anything less without a stock designed to be fired from one hand is a pistol and anything more than 26" without a stock becomes a "Firearm". Things like the Serbu Super Shorty are classified as AOW's, which is kind of a catch all category in the NFA, as they are seen as "smooth bore pistols" having an overall length less than 26". The shockwave isn't a shotgun because it wasn't designed to be fired from the shoulder (something specifically written in federal law), its not an AOW because its overall length is greater than 26" thus sparing it from the smooth bore pistol category, so it simply falls into the largely undefined (save for other definitions of items) category of firearm.
