Reading this thread is like a fucking dark rp adminhelp. Oh its justified because he had the bat first oh wait no in the instant he threw it he was unarmed so the shooting wasn't justified but oh wait the law also says in a standoff the person with the biggest gun can fire warning shots and expect no one to react ho no no the law clearly states X. The fact that theres even room for legal argument behind someone gunning someone else down is pathetic. I absolutely cannot fathom how anyone could be ok living in a society where people are ok with the idea of killing eachother over civil disputes.
1.) I am an excellent shot with my service pistol and far exceed the requirements for my police quals. I do not shoot to wound. I will shoot for the head in the event of body armor or a failure to stop. Shooting limbs is not something you do, under pressure, with a handgun. Striking the bone in the leg can cause it to shatter and produce wounds that cannot be fixed before the person bleeds out. You can also hit the femoral artery and they will bleed out before you approach the person on the ground. Leg shots can very much be fatal. 2.) Yes. It is common for a human to be dumping adrenaline if someone is pointing a firearm at them. It is also common for the people being shot by police to be using narcotics. Narcotics can further render pistol cartridges ineffective. 3.) If I had adrenaline in my system? No. Humans wouldn't be effective predators if a simple puncture wound was enough to remove us from the fight. Bullets are not magic. They make a hole in you. If that hole contains nothing of immediate value, then the body isn't going to physically fail you. You might, if you aren't a determined attacker, cease your attack, but if they aren't a determined attacker THEN YOU DON'T SHOOT THEM. Look, when Americans are like "yeah don't do that with a gun because it is dangerous" you can be pretty damn sure that we know what we are talking about

Because I only will deploy my firearm in circumstances where it is necessary for an attacker to immediately be stopped in order to prevent them from hurting someone? In all other circumstances where force is necessary, I have a taser and OC spray. I don't carry a baton because it breaks limbs and I find that to be excessive force and usually still ineffective. The reality is that I view any use of force as a failure on my part. Any time I need to use the tools on my belt/vest instead of words, I view it as a fuckup in some fashion. I didn't arrive fast enough. I didn't assess the situation quick enough. My patrol pattern wasn't effective. I didn't say the right thing at the right time to deescalate the situation. I didn't take the time to listen better the last time I was on a call with this person and as a result never developed a proper trust bond. ....I didn't know he was deaf and tackled him. Ahem. >_>

The thing is that while the two hillbillies certainly acted like mongs on their own right, Aaron Howard kept giving no shits about his own safety or the safety of his family and did everything he possibly could to elevate the conflict. Like, don't shout death threats and pretend you're doing it for the kids when you brought the kids in this very situation, especially when you have some twenty-something years behind you of repeatedly being arrested.

I haven't read the police report, but from what I can tell the first two shots were warning shots given the distance between the batter and the old man after the camera tilts back a bit. After those two shots though it appears he backed off and threw the bat, and it was after he threw the bat (which means he's now unarmed) the son decided to fire off his shotgun. I'm not sure what the laws for Texas are exactly, but in most states you're not justified in shooting the aggressor after that point; I'm expecting they're going to be found guilty.
This thread justifies my fears about ever going to the USA. The people down there are clearly tripping off something in the water if they're willing to kill eachother over a mattress. If I cut a guy off in traffic by mistake will he just shoot me? If I'm holding hands with my husband will someone shoot me? Really, how fucking broken is your society and how ass-backwards is your firearm culture that these are the kinds of petty squabbles people murder eachother over? Not over drugs, or robbery, or cheating spouses, but "hey you left a mattress outside a dumpster and we're walkin around with guns to intimidate you, and instead of calling the police now you're threatening to kill us with a baseball bad because you're scared your kids could get hurt by us, so we pumped you full of lead and didn't think anything of it" God bless fucking America. Reading the comments here makes me even more terrified.

As a Canadian, it really does. This entire thread, this entire forum, is a reactionary fun-house. I'm not different for being a little uneasy about the USA after all these things keep coming to light so frequently. Beautiful country, with some of my best friends living there/coming from there, but the scale from normal to crazy is way too sensitive. I'm fine up here with my socialism and reasonable gun laws (which are getting fucked over now, thanks Trudeau)
Situations like this are not indicative of the state of the country. Shit like this is a tragedy of two groups of idiots. It's not representative of american gun laws, americans, or anything else. It shows these 3 people were all fucking idiots.
Literally stated that in few words. The country is great, but there's way too many psychos and crazy/violent variations in people. Part of that comes from having a huge population leading to a higher probability of these kinds of things/people springing up, but if you see all these things happening down there and don't see them happening in [not already established shitty/dangerous countries], don't try to "Not all Americans tho!" me. There's so much fundamentally wrong with education, race relations, religious relations, media influence, firearms culture, and capitalist greed that yeah, hillbilly fucks like this are a lot more common in the USA than elsewhere. I would not feel safe outside of north-western states because of who I am. I didn't explicitly say "no you", I painted a picture of the forum, and one that isn't untrue. You just said "chill bro". There's nothing to argue about here. You're saying you're literally too afraid to go over a border I cross multiple times a year because of this event in the southern states. Wouldn't the guy with shotgun be fucked legally even if Howard didn't throw the bat? I'm asking because he insulted him before the dude got to the point of attacking them. Are you still in legal right to self defense if you were agitating the other person? You can't just stand call people slurs and when they attack you for it shoot them and claim self defense can you?
