I think these guys should have at least tried to back off and call the police. If the guy with the shotgun noticed he missed with the bat right away, there'd be no justification to shoot him unless he was charging.
Good luck. In a stressful situation, shooting with any amount of accuracy is very difficult even at close ranges.
Have fun legally, because not shooting to kill opens up the possibility for them to sue the ever-living shit out of you after the fact, and weakens your self-defense case in the present because if you weren't shooting to kill, then you probably weren't in fear of your life, in which case you shouldn't have shot at all.

Also when you shoot someone there is no such thing as trying to make a "non-lethal" shot. There's a reason it's called a lethal weapon, because shooting someone is always an intent to kill even if they don't die.

How would you do that? Open up your pip-boy to enter an interface where time is slowed down, and you can calculate exactly where on what limb to shoot someone and cripple them without killing them? This isn't a video game, that's why even the police aim for centermass every time.

If you have to shoot someone, you shoot to kill. If this is all you know about guns you'd probably end up shooting yourself in the foot before you shot someone else.

Well no the argument has been that the guy with the bat who has a history of violence and criminal behavior making constant death threats against people who he is infringing upon is actively putting himself in a situation that justifies firing on him. Especially when he moves to make good on those threats with a weapon.
