He didn't fire a warning shot. When the wife pointed the camera away, Aaron picked up a bat and went at the old guy, who shot him twice. Aaron threw the bat at him and got shot again because he was obviously still intent on coming at him.

It shouldn't be a surprise that youtube comments can be even stupider posts than the ones we've been dealing with in here. But that is impressive stupidity.

Here's an argument for you. You can't shoot your gun unless you are fighting for your, or someone else's life. That means you don't have the luxury of aiming at non-lethal points, if you do have the time to do that, you weren't fighting for your life and you shouldn't have fired the gun. Once words stop and turn into swings, there is no deescalation. The fight might end only if one party goes down, and when blunt weapons are involved that likely means death, (same for guns). If someone charges you with lethal intent, as he stated and has the means to, it doesn't matter who is watching, you have the right to defend yourself, at the very least in Texas. Everyone in this situation is a fucking moron. Especially the guy who got killed. You don't attack people who have firearms and who have warned you that they will kill you if you do. There's only one way this is going to end.

This is not what we're talking about. We're talking about what we THINK we should do when having a clear mind, what our logic is. What would actually happen in the heat of the moment is a different thing and nobody can truly know so it's pointless to talk about what would actually happen. HOW do you know? No but it's clear as day that the people jumping to say these men are heroes and are completely justified are only doing so because they fear that it might affect public perception of their precious firearms.

He didn't aim for a second. Talking to you is a waste of time.

If the fat duo were in the middle of a crime, they aren't protected by castle doctrine. That could fuck them no matter what. From the video, it seems like the angry man menaced a little too closely with the bat - the fat old guy arguably feared for his life, and it seems like he fired two warning shots into the dirt. Surprised, angry man tossed the bat, arguably fearing for his life. It doesn't sound like he threw it hard - more of a surprised reaction. Fat son then shoots him in the head with a shotgun. Fat old man then shots the mortally wounded angry man with his gun twice. Basically it's a shit show, but I think it comes down to the prosecution arguing that this is classed as brandishing, or that they were committing even a minor misdemeanour by dumpster diving. In which case they could go down for it. Ultimately there is clearly enough debate here that court is necessary to determine culpability and guilt.
