You're saying that the artistic elements took no effort of EA? That Key- should be able to make money off of their property but no one else should be able to do the same?
I disagree that a game is a tool for making videos on youtube. Plus you pay adobe for the purpose of making videos, you have a creative license with them. In contrast, you buy a game to play it.
I'm not saying you shouldn't be able to upload videos of games on youtube, I mean I do it. But suggesting that somone can't use your video the same way you're using someone elses is property is quiet hypocritical.

In most cases people pay for the game before making videos on it, or it is already paid for by someone else and given to the person that just made the video. EA gets money from it (unless you pirate it which isn't cool)
While key didn't make the base game, he manipulated the game in such a way that he made a video. It's his video. Machinima has no right to just come up, snap it up and not give him any credit whatsoever.

This is where copyright laws come into effect. anything, any form of art or entertainment that is created by you in ANY medium (minecraft, for example) is copyrighted to you by default as soon as it's posted. that's how someone over in the Minecraft section of the forum managed to get free server hosting for life from some company. they used his screenshot on their site without his permission, and he threatened legal action. they came to an agreement here on Facepunch. those videos on Helix's youtube are his intellectual property. Machinima stole that from him. he can sue for a percentage of the revenue they made off of that video. now shut the fuck up Ybbat. you don't know what you're talking about.

You buy the paints and pencils and paper, and with that comes the ability to create content limited to what you can do with those objects. You can post them offline, and even sell them if you wish.
When I buy a game, I buy the same. It comes with the ability to make content with it limited to what I can do with the game. I can post them online and even make money with them. That gets the game exposure, and with that exposure it will cause some people to go out and buy the game themselves so they can make their own videos with it.
Both mediums when it is in terms of creating content are similar. Content made through a videogame is someones creative work and shouldn't be stolen with "well it's just a game video."
Valve couldn't do the same either with peoples SFM videos. Just because it uses assets from TF2 and is built using their software doesn't make it valve's. Someone fucked with SFM enough to make a video out of it. That makes it theirs. Not valve's.
