The smaller E is just how the logo is formatted, and if you look closely it's still technically capitalized. The company name is properly capitalized as Valve. (Regardless, yes, the email still had it wrong.)

Still, I'm sure like it has been said before valve's CEO doesn't deal with legal issues.
