You'd lose miserably while excelling at making a fool of yourself for suing over something so moronic. It's like if you were mailed a flying in the post that advertised "20 GALLONS OF GAS, $2.99!" and you went to the station and saw that 20 gallons of gas would cost around 140 bucks. Just because something (which isn't backed by any evidence or proof of the price agreement) you saw said otherwise.

If you did take this to court you'd have to say where you saw the "sale" price; upon stating this, the case would be dismissed as the Terms and conditions of the app break the case. So, why would you never take the app into account? Your tunnel vision would do your own self in.

That's common sense as well because, why would a game store create an app that gives and lists sale prices for more or less anything. They'd most likely just create an app called "gamestop online" that would link DIRECTLY to their site. Like Best Buy's app or amazon's app.

As long as the app isn't making money off using Gamestop's logo, it's legal. Buying the app doesn't mean you just paid them for something gamestop owns. If they were posing as gamestop then yeah, they are making money off copyrighted material. Just listing the price saying "gamestop is selling a game for 99 cents!" isn't breaching copyright.

An ad app that is free to download is allowed to use logo's because it's a FREE APP. I.E they aren't making money by listing a company's sale price. You paid for the game, you downloaded the app for free.
