Ok but when I'm on the app and i click on the 2.49 price and then click on the gamestope nearest me then click "price match" it tells me "Their (gamestop store) will not match the price on "their" site)
Well then the app listed the wrong price and the price check confirmed that.
Wait.
Are you telling me that you price checked it and were given confirmation that your local store couldn't match that price and you still decided that you should sue gamestop? Are you fucking kidding me?
"This app had the wrong price; better sue the store!"
I think you should most definitely sue Gamestop.
That way I can enjoy knowing that you will lose money trying to beat them in court, and fail.

No im just checking this stuff out now. And it doesnt say anything about the price being wrong it just says that the store wont match their online price. So basically it is claiming that the gamestop website price is 2.49 This is the link given to me for the 2.49 deal. (http://bit.ly/uW6mN8 )

Okay, first off, if you were contemplating suing a large scale corporation such as Gamestop, don't you think you should have done something as rudimentary as CHECKING THE FUCKING PRICE? Also, you are once again taking an app's word over the company's word. If the OFFICIAL website itself says that a ps3 is 249.99 and a 3rd party app says 2.49, i'm pretty sure the dealer's website, the dealer who selling the god damned thing mind you, would be more reputable and official than the app's.
Looking at the price too, it just seems like they misplaced the decimal. Also, in continuing this argument i'm pretty sure now that you're just egging people on to see if you can piss them off.
Oh so you read all terms and conditions?
Well, you agree that you do in order to download the app, so it is basicly implied that you do. Also, it is common sense that there might be errors, and that a third party app, that shows you good deals, may not always have the correct information. The ad was for a PS3 for under 10 dollars, that is to good to be true, if you have common sense, since noone would ever sell a working PS3 for under 10 dollars. If it sounds to good to be true, it probably is. You have basicly been fighting over that you are correct, and that you should sue GameStop because a third party application made an error. I really cant comprehend how it is not possible to have common sense, or to even understand it after all theese posts have been made telling you why, but you can't seem to get the information in. Please start reading the terms and conditions if you want to sue someone, because they usually tell you that the product may not work perfectly all the fucking time. Its the same as that you cant sue a microwave producer because you did not read the warning to not microwave your cat.

The ShopSavvy app is claiming that GameStop lists its price as 2.49. Think of it this way, if you put something up for sale on amazon for 50 dollars and amazon says you put it up for 5 and someone buys it for five what would happen? Or if you were writing a research paper and you made up some information on your own and you quote it saying the source was from a book what would happen.

People will sue for anything, won't they?

Absolutely nothing.

Well when you're as dumb as Heatvision it's inevitable.
Absolutely nothing.
what price would the buyer be entailed to
what price would the buyer be entailed to
Thats stupid. You cant use the example with amazon, since GameStop doesnt own the app that released the incorrect price. It doesnt matter what the app said, since GameStops website is the correct one. Gamestops website is always correct, especiallt in compariosn to a third party app.

So it seems it is just copyright infringement on ShopSavvys part because they listed gamestop as selling the ps3 for 2.49. They basically created a false gamestop ad.

no.
it's a listing.
wowza is Heatvision still going on with this?
I thought this thread would have been dead by now.

No, they didnt make a false ad fir gamestop, they made an error in their program that found deals for you. There was never an advertisement. It wouldnt be an ad because i said a PS3 cost a dollar, and it isnt an ad becuase ShopSavvvy said it cost two.
So it seems it is just copyright infringement on ShopSavvys part because they listed gamestop as selling the ps3 for 2.49. They basically created a false gamestop ad.
It's not a false gamestop ad ffs, it's like an ad in the newspaper. FREE HOUSE AT 444 FUCKSHITCUNT LANE!!!@@@, this is a listing.
Now, if you got a flyer with Gamestops logo and everything related to that shithole and it had that price for a PS3, then it would be legit, but it's a listing. All credibility lost.
Okay, i tried leaving this thread and for the op to toil around in his own ignorance but god damn he is just too easy to pick on and is resilient.

The research paper was a horrible analogy. As for the amazon analogy, that's another horrible analogy because on the amazon marketplace, you sell your product at your price; Amazon can't alter the price. It's also horrible because we are now talking about 1 medium, an amazon page. What you wanted to sue for was a 3rd party app that misplaced a decimal and accidentally claimed that gamestop will sell a ps3 for less than 3 dollars. That is 2 mediums, one is ran by the company selling the items and is OFFICIAL. OFFICIAL. OFFICIAL. OFFICIAL. OFFICIAL. OFFICIAL. OFFICIAL. OFFICIAL. OFFICIAL. OFFICIAL. OFFICIAL. OFFICIAL. OFFICIAL. OFFICIAL. OFFICIAL. OFFICIAL. While the other is THIRD PARTY INDEPENDENT APPLICATION ON A SMARTPHONE WITH NO TIES AT ALL WHAT SO EVER OR AFFILIATION IN THE SLIGHTEST. THIRD PARTY. THIRD PARTY. THIRD PARTY.
Only one has the ability to alter prices, the other just puts them in a list. And i hope to god that you take notice of what is bolder and their differences.

Technically they did and didn't; They created an ad with the wrong price. It's not copyright infringement at all because you: Did not buy the app. and ShopSavvy: did not profit monetarily from producing the ad.

I think this is enough to end this thread.
Heatvision is just narrow minded and wont accept that an app that wasn't made by Gamestop is lying about a discount on a PS3.
I thought the worst posts of 2011 thread made me realize how infinite human stupidity is but wow this entire thread just takes the cake.
no.

A listing that had gamestop as a participant offering 2.50 for a ps3
A listing that had gamestop as a participant offering 2.50 for a ps3
wow okay I see.
It's not
GAMESTOPS LISTING
my oh my.
I don't know if this has been settled yet, but the gamestop site's terms of uses states:
Typographical Errors
In the event a product price is listed incorrectly due to typographical error or error in pricing information received from our vendors, GameStop shall have the right to refuse or cancel any orders placed for product listed at the incorrect price, regardless of whether the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, GameStop will immediately credit your credit card account in the amount of the incorrect price.
Settles it. Either the Gamestop System had an incorrect price and therefore OP legally has to deal with it, or a third party vendor fucked up the price and OP legally has to deal with it. Either way, the OP is wrong.
A listing that had gamestop as a participant offering 2.50 for a ps3
gamestop had nothing to do with it
you must be from the south or something
gamestop had nothing to do with it

If he lives in Alabama then this thread is just perfect.
how about i send you an email that says gamestop is offering a ps3 for 3 dollars
and i use their logo
Why is it so hard for you to understand that Gamestop has nothing to do with this.
It could even say it's from Best Buy and still have no connection to them. You just wanna make a big deal and go all sue happy, but in reality you're a fool for even saying you will sue them.
Go ahead and try to, watch as you fall through the cracks, you're already falling so lets just dig a deeper hole shall we?
Ok I get it thanks
biggest retard on fp, and oh what do we have here, a mac owner. (not saying all apple fans are bad, but it seems some of the people who buy their products are..)

Sorry, I went to a small high school that didnt really teach about american laws so i dont know all the ins and outs just the basic stuff eventhough this may be common sense to you guys
I don't know why, if my friend wrote me a note that said you were selling a ps3 for $2.50 and forged your signature do you think it would be fair to sue you if you did not live up to that price?
Sorry, you need to Log In to post a reply to this thread.
