Pirating isn't even technically illegal in most places as you won't actually get arrested for it. It's more of a moral issue.

And if it's an older game where the profits won't even reach the publisher it's even less of a problem really.
Actually seeding torrents is illegal (in most countries) whereas leeching is completely fine in most cases.
