Actually they technically do. They are under a creative commons licence. That's not to say you can't make a lobby-like gamemode.

Yes but he's not calling it GMT. He's making a lobby/lounge gamemode with the same general concept as GMT. As long as he's not stealing code or replicating exactly what the GMT team is doing it's not illegal.
