Yes. There is no fee to cancel once your contract is up. You do however have to give 30 days notice before your service is terminated.

Dumb question, Im sure, but if I root and [i]don't[/i] flash a new ROM, will I lose my data? I'm considering reevezy's advice on underclocking while the screen is locked. If Moto won't fix my battery drain, I will.

There are ways to backup data without root.

Nobody who writes for them actually understands technology. They're just people who write well that are told to write about whatever piece of technology lands on their desk. Here's my favourite bit. Even worse is they couldn't even understand what they saw IN THEIR OWN PICTURE! There's no extra blue, there's a red, blue and green per pixel, with the blue being larger but not as bright. They do not write based on technical knowledge, they write based on whatever "logic" pops into their head at the moment of writing.

From what I've read, the Maxx has a locked bootloader and no official unlock code. But this should not affect root, just custom roms (also from what I've read). Sound about right?

Set CPU is the same thing just by itself, also costs $$. Go to the performance tab > CPU settings(or something like that). Slide the screen to get to the profile section, tick the box that says "use profiles". Add two profiles, one for screen on and one for screen off. For the screen on profile, set the max and min to whatever you like mine is just the default settings with interactive as the governor. For the "screen off" profile set both of the sliders to the minimum and set the governor to ondemand(powersave seems to lag when trying to unlock the phone), set the priority on this one lower than the priority that was set for "screen on". You can experiment with these, I actually set my phone to the powerful governor(keeps the phone on the highest clock speed) when the screen is on, keeps it really fast and surprisingly doesn't use much more battery than a dynamic clock speed, I think it's because switching between different clock speeds all the time drains the battery. It saves much more battery when in an area with low HSPA coverage. Also, in places where 3G just isn't available, 2G most likely is. With Bell, I'd just have no service. There are surprisingly many deadspots on the Lower Mainland area.
